A bill for an act
relating to economic development; appropriating money for payments to
bioindustrial facilities.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPROPRIATION; PAYMENTS TO BIOINDUSTRIAL FACILITIES.

new text begin (a) $15,000,000 in fiscal year 2026 is appropriated from the Minnesota forward fund
account in the climate and economic development fund to the commissioner of employment
and economic development for payments to businesses that made private investments for
land development, utility infrastructure, building, construction, and machinery and equipment
purchases for the purpose of constructing and operating a bioindustrial facility to produce
advanced biofuels, renewable chemicals, and biomass thermal energy or production that
began before June 30, 2024.

new text begin (b) Beginning August 1, 2026, the commissioner of employment and economic
development shall begin accepting applications for payments to existing bioindustrial
facilities producing advanced biofuels, renewable chemicals, or biomass thermal energy.
Payments shall be made to companies that received funding for incentive payments under
Minnesota Statutes, section 41A.16, 41A.17, or 41A.18, prior to January 31, 2025.
Applications for payments shall include copies of claims submitted under Minnesota Statutes,
section 41A.16, 41A.17, or 41A.18. Payments shall be equal to the amount of any claim
made on or before April 30, 2025, that has not been paid by May 15, 2025. This is a onetime
appropriation and is available until July 1, 2027.

Laws 2023, chapter 53, article 21, section 7, paragraph (b), is canceled.
