A bill for an act
relating to health insurance; requiring providers of outpatient behavioral health
services to be paid at least 143 percent of the Medicare rate; proposing coding for
new law in Minnesota Statutes, chapter 62Q.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) A health plan company shall pay a health care provider at least 143 percent of the
Medicare rate as published in the Centers for Medicare and Medicaid Services annual final
rule updating payments and policies for outpatient behavioral health services. Outpatient
behavioral health services include but are not limited to outpatient substance use disorder
and mental health treatment.

(b) This section does not apply to coverage provided to state public health care program
enrollees under chapter 256B or 256L.
