A bill for an act
relating to local government; prohibiting outgoing officials from voting on new
municipal debt obligations; amending Minnesota Statutes 2024, sections 475.51,
by adding a subdivision; 475.52, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 475.51, is amended by adding a subdivision
to read:

new text begin "Outgoing official" means a person who is serving the
remainder of the person's term in an elected or appointed position in a governing body after
the election or appointment of the person's successor.

Sec. 2.

Minnesota Statutes 2024, section 475.52, is amended by adding a subdivision to
read:

new text begin Limitation on outgoing officials. new text end

new text begin (a) An outgoing official must abstain from
any vote by the governing body of a municipality to issue a new obligation of the
municipality. If an outgoing local official votes in violation of this paragraph, the governing
body must not count the outgoing official's vote.

new text begin (b) Paragraph (a) does not apply to the issuance of a new obligation that is subject to
approval of a majority of electors under section 475.58.
