A bill for an act
 relating to state government; providing flexibility for the commissioner of
administration to determine eligibility for the preference in state contracting for
small businesses; amending Minnesota Statutes 2024, section 16C.16, subdivision
2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 16C.16, subdivision 2, is amended to read:


Subd. 2.

Small business.

The commissioner shall adopt the size standards for deleted text begin "small
business" found in Code of Federal Regulations, title 49, section 26.65,deleted text end new text begin a small businessnew text end
for purposes of sections 16C.16 to 16C.21, 137.31, 137.35, 161.321, and 473.142, provided
that the business has its principal place of business in Minnesota.new text begin The commissioner may
