A bill for an act
relating to education; allowing students to complete state assessments remotely;
appropriating money; amending Minnesota Statutes 2024, section 120B.30,
subdivision 11, by adding subdivisions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2024, section 120B.30, subdivision 11, is amended to read:
(a) The commissioner must determine the testing process
and the order of administration.
(b) The commissioner must establish a testing period as late as possible each school year
during which schools must administer the Minnesota Comprehensive Assessments to
students. The commissioner must publish the testing schedule at least two years before the
beginning of the testing period.

(c) The commissioner must review and update assessment administration and security
policies as necessary to maintain the integrity of state assessments.

Minnesota Statutes 2024, section 120B.30, is amended by adding a subdivision to
read:

(a) The commissioner must adopt policies
and procedures necessary to administer state assessments remotely to a student enrolled in
an online instructional site under section 124D.094, subdivision 1. Starting in the 2026-2027
school year, the department must allow a student enrolled in an online instructional site to
participate in state assessments remotely.

(b) The remote assessment policies and procedures must include:

(1) testing personnel qualifications;
new text end
new text begin
(2) a maximum ratio of students to remote proctor;
new text end
new text begin
(3) testing verification;
new text end
new text begin
(4) remote setting requirements, including any restrictions related to technology or
Internet access;

(5) monitoring of the student and the testing environment during the test administration;

(6) device and networking requirements; and
new text end
new text begin
(7) parental consent agreements.

(c) The remote assessment policies and procedures must support the validation activities
necessary to administer state assessments remotely. To establish the validity of remotely
administered state assessments, the department must conduct validation activities, gather
data, and evaluate the comparability of scores between remotely administered state
assessments and state assessments administered in person at a school site. To encourage
student and educator participation in validation activities, the department may provide
incentives.

the process of collecting evidence to evaluate the appropriateness of the interpretations of,
uses for, and decisions made based on state assessment results.

designated.
