A bill for an act
relating to state lands; requiring legislative approval for certain sales, transfers, or
other conveyances of state-owned land; amending Minnesota Statutes 2024, section
94.09, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 94.09, is amended by adding a subdivision
to read:

new text begin (a) Notwithstanding any other provision of law, the
commissioner of natural resources may not sell, transfer, or otherwise convey any real
property belonging to the state:

new text begin (1) in excess of 100 acres, unless the specific sale, transfer, or conveyance is authorized
by law; or
new text end

new text begin (2) in excess of 1,000 acres, unless the specific sale, transfer, or conveyance is authorized
by a law that is adopted by a vote of at least three-fifths of the members of each house of
the legislature.

new text begin (b) A law that confers general authority on the commissioner to sell, transfer, or convey
real property but that does not refer to the specific real property belonging to the state to be
sold, transferred, or conveyed does not satisfy the requirements of paragraph (a).

new text begin (c) This subdivision does not prohibit the lease of real property belonging to the state.

new text begin (d) For purposes of this subdivision, the term "real property belonging to the state" means
any tract, lot, or parcel, or any group of contiguous tracts, lots, or parcels of real property
belonging to the state.
