A bill for an act
relating to data practices; prohibiting government entities from sharing personally
identifiable information with federal agencies; proposing coding for new law in
Minnesota Statutes, chapter 13.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin For purposes of this section, "personally identifiable
information" means any government data in which an individual is or can be identified as
the subject of the data.

new text begin Prohibited data sharing. new text end

new text begin (a) Notwithstanding any law to the contrary and
except as provided in paragraph (b), a government entity must not disseminate to a federal
official or agency data of any classification that contains personally identifiable information
unless the data is first masked or otherwise anonymized.

new text begin (b) A government entity may share personally identifiable information with federal
officials or agencies only to the extent necessary to comply with a state statute or federal
law or pursuant to a court order.
