A bill for an act
relating to local government; permitting the city of Buffalo to establish a public
utilities commission with five members.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Notwithstanding Minnesota Statutes, sections 412.331 and 412.341, the city of
Buffalo may establish a public utilities commission with five members by an ordinance
that:

(1) expressly adopts the provisions of paragraph (b) in place of the provisions in
Minnesota Statutes, section 412.341, subdivision 1; and

(2) otherwise complies with the requirements of Minnesota Statutes, section 412.331,
including by expressly adopting all other provisions of Minnesota Statutes, sections 412.331
to 412.391.

(b) The commission shall consist of five members appointed by the council. No more
than two members may be chosen from the council membership. Each member shall serve
for a term of three years and until a successor is appointed and qualified except that of the
members initially appointed in any city, two shall serve for a term of one year, two for a
term of two years, and one for a term of three years.

This section is effective the day after the city of Buffalo and its
chief clerical officer comply with the requirements of Minnesota Statutes, section 645.021,
subdivisions 2 and 3.
