A bill for an act
relating to solid waste; requiring surety bond for tire collectors; amending
Minnesota Statutes 2024, section 115A.902, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2024, section 115A.902, is amended by adding a subdivision
to read:

Before a permit is issued or renewed, a tire collector that
is required to obtain a permit under subdivision 1 must have on file with the commissioner
a surety bond executed by a surety company authorized to do business in the state in the
sum of at least $150,000. The bond must be continuous in nature until canceled by the
surety. A surety must provide at least a 30-day notice in writing to the tire collector and to
the commissioner indicating the surety's intent to cancel the bond and the effective date of
the cancellation. The surety bond must be for the benefit of the citizens of the state and must
be conditioned upon the tire collector's willingness to comply with sections 115A.90 to
115A.914 and rules adopted thereunder. The surety's liability under this subdivision is
limited to the amount of the bond or the amount of the damages or moneys due, whichever
is less. This subdivision does not limit the amount of damages recoverable from a tire
collector to the amount of the surety bond. The bond must be made in a form prescribed by
the commissioner.
