A bill for an act
relating to transportation; authorizing placement of automated license plate readers
in certain highway rights-of-way; amending Minnesota Statutes 2024, section
160.27, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 160.27, is amended by adding a subdivision
to read:

new text begin (a) For purposes of this subdivision, the
following terms have the meanings given:

new text begin (1) "automated license plate reader" has the meaning given in section 13.824, subdivision
1;
new text end

new text begin (2) "highway authority" means the commissioner with respect to trunk highways, and
a county with respect to county state-aid highways and county highways under its jurisdiction;
and

new text begin (3) "law enforcement agency" has the meaning given in section 626.84, subdivision 1,
paragraph (f).

new text begin (b) Notwithstanding section 160.2715, a local law enforcement agency may place and
operate an automated license plate reader at a stationary location within the right-of-way
of a trunk highway, county state-aid highway, or county highway if:

new text begin (1) the law enforcement agency provides notice to the highway authority that:
new text end

new text begin (i) is submitted at least 14 days prior to placement at, and immediately following removal
from, each location; and
new text end

new text begin (ii) includes specific location information for each automated license plate reader;
new text end

new text begin (2) the automated license plate reader is affixed to an existing traffic sign, lighting device,
or traffic-control device or is placed following guidance developed by the commissioner;

new text begin (3) the automated license plate reader is not located in a manner that constitutes a hazard
of collision for motorists or impairs proper function of the highway; and

new text begin (4) the location is within the jurisdiction of the law enforcement agency.
