A bill for an act
relating to environment; prohibiting the commissioner from adopting rules that
apply only to construction and demolition landfills; amending Minnesota Statutes
2024, section 115A.06, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 115A.06, subdivision 2, is amended to read:

Subd. 2.

Rules.

new text begin (a) new text end Unless otherwise provided, the commissioner shall promulgate rules
in accordance with chapter 14 to govern the agency's activities and implement this chapter.

new text begin (b) Notwithstanding paragraph (a) or any other provision of law, the commissioner must
not adopt any rules that exclusively govern solid waste disposal facilities that accept only:

new text begin (1) construction and demolition debris and incidental nonrecyclable packaging; or

new text begin (2) industrial waste that is limited to wood, concrete, porcelain fixtures, shingles, or
window glass resulting from the manufacture of construction materials.

new text begin This section is effective the day following final enactment and
applies to any proposed or adopted rule not yet effective on or after that date.
