A bill for an act
relating to state government; allowing legislative auditor to bring a civil or criminal
complaint; establishing authority for county attorneys to prosecute certain claims;
amending Minnesota Statutes 2024, section 3.971, by adding subdivisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 3.971, is amended by adding a subdivision
to read:

new text begin Civil or criminal complaint. new text end

new text begin For occurrences of fraud or maladministration
of taxpayer-funded programs, the legislative auditor is authorized to bring a civil action or
criminal complaint under Minnesota law in the office's name as the legislative auditor. The
standing of any state department to sue or be sued under applicable law must not be affected
by any civil action or criminal complaint under this subdivision.

Sec. 2.

Minnesota Statutes 2024, section 3.971, is amended by adding a subdivision to
read:
