A bill for an act
relating to transportation; modifying requirements of photographs on drivers'
licenses and identification cards for certain individuals with medical devices;
amending Minnesota Statutes 2024, section 171.071, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 171.071, subdivision 2, is amended to read:


Subd. 2.

Certain head wear permitted.

new text begin (a) new text end If an accident involving a head injury,
serious illness, or treatment of the illness has resulted in hair loss by an applicant for a
driver's license or identification card, the commissioner deleted text begin shalldeleted text end new text begin mustnew text end permit the applicant to
wear a hat or similar head wear in the photograph or electronically produced image. The
hat or head wear must be of an appropriate size and type to allow identification of the holder
of the license or card and must not obscure the holder's face.

new text begin (b) If an applicant, as a result of serious illness or injury or from the treatment or
management of an illness or injury, is medically required to maintain continuous coverage
of the applicant's head or scalp, the commissioner must not require the removal of the
medically required covering for the photograph or electronically produced image, provided:

new text begin (1) the applicant provides a physician's statement as provided in paragraph (c); and

new text begin (2) the covering does not completely obscure the applicant's face.

new text begin (c) A physician's statement submitted by an applicant under paragraph (b) must (1)
affirm that the applicant requires continuous coverage of the applicant's head or scalp, (2)
affirm the applicant must not remove the medically required covering, and (3) indicate
whether the applicant's condition is temporary or permanent. If the physician's statement
indicates the need for a medical covering on a temporary basis, the applicant must submit
a new photograph upon renewal of the driver's license or identification card.
