A bill for an act
relating to construction codes; exempting certain well contractors from Department
of Labor and Industry plan review and inspection requirements; clarifying existing
exemptions to contractor licensing, registration, and bonding requirements;
amending Minnesota Statutes 2024, sections 326B.43, by adding a subdivision;
326B.46, subdivision 6.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2024, section 326B.43, is amended by adding a subdivision
to read:

A well contractor or a limited well/boring
contractor is exempt from plan and specification reviews and inspections under this chapter
if the contractor is:

(1) licensed and bonded under section 103I.525 or 103I.531;
new text end
new text begin
(2) performing work approved under section 144.383; and
new text end
new text begin
(3) engaged in the work or business of designing and installing:

new text begin
(i) water service or supply pipes from or between a well, a water supply storage tank
system, the final pressure tanks, and the master shutoff valve leading to distribution;
new text end
new text begin
(ii) a frost-free water hydrant with an antisiphon device located outside of a building
requiring potable water;
new text end
new text begin
(iii) a control valve, located outside the building, on a well water service pipe; or
new text end
new text begin
(iv) a master shutoff valve located within three feet of the final pressure tank leading to
the distribution line.

Minnesota Statutes 2024, section 326B.46, subdivision 6, is amended to read:
No license,
registration, or bond under sections 326B.42 to 326B.49 is required of a well contractor or
a limited well/boring contractor who is deleted text begin licensed and bonded under section 103I.525 or
103I.531 and is engaged in the work or business of designing and installingdeleted text end :
