A bill for an act
relating to transportation; requiring local approval before Department of
Transportation may acquire easements for certain road projects; proposing coding
for new law in Minnesota Statutes, chapter 160.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) For purposes of this section, the following terms have
the meanings given.

new text begin (b) "Easement" means the acquisition or designation of private or public land for the
purpose of constructing, maintaining, or improving certain project elements related to a
road construction project.

new text begin (c) "Local approval" means the approval by a statutory or home rule charter city, county,
or town either by:

new text begin (1) a formal resolution adopted by the governing body of the local government unit; or
new text end

new text begin (2) a vote at the next general election and, if approved by a majority of those voting on
the question, becoming effective following the final canvass of the election.

new text begin (d) "Roadway project elements" means the construction, maintenance, improvement,
capacity expansion, reconstruction, resurfacing, or any other development of roadway
infrastructure including shoulders, ditches, and culverts for the exclusive use of motor
vehicle travel on the trunk highway system.

are not roadway project elements must receive local approval before funds from sections
85.53, 114D.50, and 129D.17, may be expended to acquire property by easement.

new text begin This section is effective July 1, 2025, for easements entered into
on or after that date.
