relating to health care; creating the Gender-Affirming Rights Act; proposing coding
for new law in Minnesota Statutes, chapter 145.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

This section may be cited as the "Gender-Affirming Rights
Act."

new text begin
"Gender-affirming care" means a service or product that a health
care provider prescribes or provides to an individual to support and affirm the individual's
gender identity. Gender-affirming care includes but is not limited to treatment for gender
dysphoria. Gender-affirming treatment can be prescribed to Two Spirit, transgender,
nonbinary, and other gender diverse individuals.

Every individual has a fundamental right to make autonomous
decisions about the individual's own gender, and related gender-affirming health care.

The Minnesota Constitution establishes
the principles of individual liberty, personal privacy, and equality. These principles ensure
the right to gender-affirming health care.

A local unit of government may not
regulate an individual's right to freely exercise the fundamental rights set forth in this section
in a manner that is more restrictive than that set forth in this section.

This section is effective the day following final enactment.
