A bill for an act
relating to health; establishing a blanket hospital construction moratorium exception
for increasing mental health bed capacity; amending Minnesota Statutes 2020,
section 144.551, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 144.551, is amended by adding a subdivision
to read:

new text begin Subdivision 1, paragraph
(a), and sections 144.552 and 144.553 do not apply to:

new text begin (1) those portions of any structure, building, alteration, reconstruction, modernization,
improvement, extension, lease, or other acquisition by or on behalf of a hospital that increases
the mental health bed capacity of a hospital; or

new text begin (2) the establishment of a new psychiatric hospital.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective August 1, 2022, and applies to any
projects commenced on or after that date.
