A bill for an act
relating to transportation; exempting towing and recovery vehicles from certain
motor vehicle weight limitations; amending Minnesota Statutes 2020, section
169.87, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 169.87, is amended by adding a subdivision
to read:

new text begin Towing and recovery vehicles. new text end

new text begin (a) Subject to paragraph (b), weight restrictions
imposed under subdivisions 1 and 2 do not apply to a towing vehicle or other recovery
vehicle that is being operated to tow or recover another vehicle that:

new text begin (1) is involved in a vehicle crash or is inoperable, and is located within a public road
right-of-way;

new text begin (2) has entered a public body of water; or
new text end

new text begin (3) is exempt from the restrictions under subdivision 1 or 2, as appropriate.

new text begin (b) The exemption under this subdivision only applies when the towing or recovery
vehicle is traveling to tow or recover a vehicle specified in paragraph (a), clauses (1) to (3),
or is towing or recovering a vehicle specified in paragraph (a), clauses (1) to (3).
