A bill for an act
relating to environment; limiting installers liability for damages caused by
subsurface sewage treatment systems; amending Minnesota Statutes 2020, section
115.55, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 115.55, is amended by adding a subdivision
to read:

new text begin Installers not liable. new text end

new text begin Absent gross negligence or willful misconduct, an
installer that constructs or repairs a subsurface sewage treatment system in compliance with
all state and local laws applicable at the time of the construction or repair is not liable for
injuries or damages to a person or property resulting from use of the subsurface sewage
treatment system after the system is constructed or repaired.
