A bill for an act
relating to health; limiting the general authority of the commissioner of health;
amending Minnesota Statutes 2018, section 144.05, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 144.05, is amended by adding a subdivision
to read:

authority granted under subdivision 1 do not authorize the commissioner to impose
requirements, spend funds, or issue grants related to collection, storage, or analysis of patient
health information without explicit authorization in state statute for that specific activity.
