A bill for an act
relating to data practices; restricting the right of certain peace officers to access
video evidence of incidents that result in an officer's discharge of a firearm;
amending Minnesota Statutes 2014, section 13.82, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2014, section 13.82, is amended by adding a subdivision
to read:

(a)
Notwithstanding section 13.04, subdivision 3, or any other law to the contrary, video
evidence of a peace officer's response to an incident, if the incident results in the officer's
discharge of a firearm, may not be made accessible to any peace officer involved in
the response, unless the video evidence constitutes inactive investigative data under
subdivision 7 or has been made accessible to the public under subdivision 15.

(b) This subdivision does not restrict the right of a peace officer to receive or access
evidence pursuant to the rules of discovery in a civil or criminal proceeding.
