1.1A bill for an act 1.2relating to transportation; providing for obedience to school bus flaggers; 1.3modifying speed limit requirements for a segment of marked Interstate Highway 1.435E; requiring certain signage on laned highways; providing that bus driver 1.5is not subject to seat belt fines arising out of violations by certain passengers; 1.6amending Minnesota Statutes 2014, sections 169.06, by adding a subdivision; 1.7169.14, by adding subdivisions; 169.18, subdivision 7; 169.686, subdivision 1. 1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9    Section 1. Minnesota Statutes 2014, section 169.06, is amended by adding a 1.10subdivision to read: 1.11    new text begin Subd. 4b.new text end new text begin Obedience to school bus flagger.new text end new text begin (a) A person may stop and hold new text end 1.12new text begin vehicles in place at a location on a street or highway having one lane of traffic in each new text end 1.13new text begin direction and a speed limit of 35 miles per hour or less until it is safe for the vehicles new text end 1.14new text begin to proceed, if the person:new text end 1.15new text begin (1) is designated by the school district's transportation safety director to act as a new text end 1.16new text begin school bus flagger;new text end 1.17new text begin (2) controls traffic in order to enable one or more school buses to safely leave school new text end 1.18new text begin property and enter the adjacent street or highway, or to safely enter school property from new text end 1.19new text begin the adjacent street or highway; andnew text end 1.20new text begin (3) meets the safety and equipment standards of an adult crossing guard as provided new text end 1.21new text begin in the manual and specifications adopted under subdivision 1.new text end 1.22new text begin (b) A person operating a motor vehicle that has been stopped by a school bus flagger new text end 1.23new text begin may proceed after stopping only on instruction by the school bus flagger or a police officer.new text end 2.1new text begin (c) The authority under paragraph (a) does not apply in a school zone established new text end 2.2new text begin under section 169.14, subdivision 5a, in which the speed limit of that street or highway new text end 2.3new text begin outside the school zone is higher than 35 miles per hour.new text end 2.4    Sec. 2. Minnesota Statutes 2014, section 169.14, is amended by adding a subdivision 2.5to read: 2.6    new text begin Subd. 2b.new text end new text begin Speed limit; marked Interstate Highway 35E.new text end new text begin Notwithstanding new text end 2.7new text begin subdivision 2, the commissioner shall designate the speed limit on marked Interstate new text end 2.8new text begin Highway 35E in St. Paul, from the interchange with marked Trunk Highway 5, known as new text end 2.9new text begin West Seventh Street, to the interchange with marked Interstate Highway 94, as 55 miles new text end 2.10new text begin per hour unless the commissioner designates a different speed limit on that highway new text end 2.11new text begin after (1) conducting an engineering and traffic investigation under subdivision 4, and (2) new text end 2.12new text begin determining that a different speed limit is reasonable and safe. Any speed in excess of a new text end 2.13new text begin speed limit designated under this subdivision is unlawful.new text end 2.14new text begin EFFECTIVE DATE.new text end new text begin This section is effective the day following final enactment.new text end 2.15    Sec. 3. Minnesota Statutes 2014, section 169.14, is amended by adding a subdivision 2.16to read: 2.17    new text begin Subd. 5g.new text end new text begin Conviction recording; marked Interstate Highway 35E.new text end new text begin Except as new text end 2.18new text begin provided in section 171.12, subdivision 6, paragraph (c), the Department of Public Safety new text end 2.19new text begin shall not keep on the record of a driver any conviction for a violation of a speed limit on new text end 2.20new text begin marked Interstate Highway 35E in the city of St. Paul, from its intersection with West new text end 2.21new text begin Seventh Street to its intersection with marked Interstate Highway 94, unless the violation new text end 2.22new text begin consists of a speed greater than ten miles per hour in excess of the speed limit.new text end 2.23    Sec. 4. Minnesota Statutes 2014, section 169.18, subdivision 7, is amended to read: 2.24    Subd. 7. Laned highway. When any roadway has been divided into two or more 2.25clearly marked lanes for traffic, the following rules, in addition to all others consistent 2.26herewith, shall apply: 2.27(a) A vehicle shall be driven as nearly as practicable entirely within a single lane 2.28and shall not be moved from such lane until the driver has first ascertained that such 2.29movement can be made with safety. 2.30(b) Upon a roadway which is not a one-way roadway and which is divided into three 2.31lanes, a vehicle shall not be driven in the center lane except when overtaking and passing 2.32another vehicle where the roadway is clearly visible and such center lane is clear of traffic 2.33within a safe distance, or in preparation for a left turn or where such center lane is at the 3.1time allocated exclusively to traffic moving in the direction the vehicle is proceeding, and 3.2is signposted to give notice of such allocation. The left lane of a three-lane roadway which 3.3is not a one-way roadway shall not be used for overtaking and passing another vehicle. 3.4(c) Official signs may be erectednew text begin by a road authoritynew text end directing slow-moving traffic to 3.5use a designated lane or allocating specified lanes to traffic moving in the same direction, 3.6andnew text begin must be erected as appropriate to instruct motorists of the requirements under new text end 3.7new text begin subdivision 10.new text end Drivers of vehicles shall obey the directions of every such sign. 3.8(d) Whenever a bicycle lane has been established on a roadway, any person 3.9operating a motor vehicle on such roadway shall not drive in the bicycle lane except to 3.10perform parking maneuvers in order to park where parking is permitted, to enter or leave 3.11the highway, or to prepare for a turn as provided in section 169.19, subdivision 1. 3.12new text begin (e) A vehicle must be driven in the right-hand lane according to subdivision 10.new text end 3.13    Sec. 5. Minnesota Statutes 2014, section 169.686, subdivision 1, is amended to read: 3.14    Subdivision 1. Seat belt requirement. (a) Except as provided in section 169.685, a 3.15properly adjusted and fastened seat belt, including both the shoulder and lap belt when the 3.16vehicle is so equipped, shall be worn by the driver and passengers of a passenger vehicle, 3.17commercial motor vehicle, type III vehicle, and type III Head Start vehicle. 3.18(b) A person who is 15 years of age or older and who violates paragraph (a) is 3.19subject to a fine of $25. The driver of the vehicle in which a violation occurs is subject to 3.20a $25 fine for each violation of paragraph (a) by the driver or by a passenger under the 3.21age of 15, but the court may not impose more than one surcharge under section 357.021, 3.22subdivision 6 , on the driver. The Department of Public Safety shall not record a violation 3.23of this subdivision on a person's driving record. 3.24new text begin (c) The driver of a bus is not subject to the fine under paragraph (b) for a violation of new text end 3.25new text begin paragraph (a) by a passenger under the age of 15.
