A bill for an act
relating to education finance; reimbursing school districts' additional costs
attributable to the Affordable Care Act; appropriating money; proposing coding
for new law in Minnesota Statutes, chapter 127A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.

[127A.39] STATE AID PAYMENTS FOR ADDITIONAL HEALTH
CARE COSTS.

A school district or charter school that is subject to
an employer penalty under the Affordable Care Act or that has higher total employer-paid
health insurance costs under the Affordable Care Act than the district or charter school
had prior to the implementation of the act qualifies for state aid equal to that amount.

A school district's or charter school's Affordable Care Act
state aid for each year equals the district's or charter school's eligible aid amount calculated
for the previous fiscal year. Each district or charter school must notify the commissioner
of this amount in the form and manner specified by the commissioner.

The amount of the aid calculated under this section must
be included in the district's or charter school's aid payments under section 127A.45.

This section is effective for state aid payments for fiscal
year 2015 and later.
