A bill for an act
relating to traffic regulations; increasing penalties for unlawful passing on the
right resulting in bodily injury or death; amending Minnesota Statutes 2010,
section 169.18, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2010, section 169.18, is amended by adding a
subdivision to read:

new text begin Passing on the right resulting in bodily injury or death. new text end

(a) It is a
violation for a driver to pass on the right or the shoulder of a road or highway except:

(1) in accordance with subdivision 4;
new text end
new text begin
(2) when operating a bus on a shoulder in accordance with section 169.306;
new text end
new text begin
(3) when passing on a dynamic shoulder lane as authorized by section 160.93;
new text end
new text begin
(4) when operating an authorized emergency vehicle while responding to an
emergency;

new text begin
(5) when directed to do so by a peace officer; or
new text end
new text begin
(6) when necessary to avoid a traffic accident or injury to self or another.

(b) A person who commits a violation of paragraph (a) resulting in substantial or
great bodily harm, as defined in section 609.02, subdivision 7a or 8, is guilty of a gross
misdemeanor.

(c) A person who commits a violation of paragraph (a) resulting in death is guilty of
a felony.

This section is effective August 1, 2011, for violations
committed on or after that date.
