1.1A bill for an act 1.2relating to insurance coverage; requiring the commissioner of commerce to 1.3establish an open enrollment period for child-only health plans. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5    Section 1. new text begin OPEN ENROLLMENT PERIOD FOR CHILD-ONLY HEALTH new text end 1.6 new text begin PLANS. new text end 1.7 new text begin (a) The commissioner of commerce, in consultation with representatives of the new text end 1.8 new text begin health plan companies, shall establish a mandatory open enrollment period or periods in new text end 1.9 new text begin which health plan companies offering or issuing child-only individual health plans within new text end 1.10 new text begin the state must offer coverage on a guaranteed-issue basis to children under the age of 19. new text end 1.11 new text begin (b) The commissioner shall determine the number and length of the open enrollment new text end 1.12 new text begin periods so long as an initial open enrollment period is commenced before December 31, new text end 1.13 new text begin 2010, for a period of at least 30 days, and at least one open enrollment period occurs new text end 1.14 new text begin annually for a period of at least 30 days. new text end 1.15 new text begin EFFECTIVE DATE. new text end new text begin This section is effective the day following final enactment. new text end
