Relating to education;

ARTICLE 1 - GENERAL EDUCATION

Clarifying that the investment income earned by the permanent school fund includes interest earned on the certified monthly earnings prior to the transfer to the department of education; authorizing a school district that is renewing a capital project referendum at the same tax rate to state on the ballot that the capital project is being reviewed and its tax rate is not being increased over previous years rate; allowing postsecondary institutions to charge for nonreturned textbooks and classroom material; modifying general education revenue calculation for purposes of determining excess cost aid; clarifying maximum amount of annual levy authority a school district has for retired employee health benefits; modifying nonpublic school aid

ARTICLE 2 - EDUCATION EXCELLENCE

Modifying assessment of performance, reporting and documentation provisions relating to home schooling; exempting certain documentation maintenance provisions for accredited nonpublic schools; adding physical education to the list of state-required academic standards; authorizing charter schools to provide programs for gifted and talented programs; modifying certain mental health provisions; modifying students graduation assessment scoring on transcripts; instructing the commissioner of education to establish a statewide high school algebra end of course assessment for certain students; excluding personally identifiable information from publicly reported test results; giving individuals access to exams they complete; directing the commissioner to report on certain measures that demonstrate the success of school districts; establishing school performance report cards to track improvement of certain at risk students; eliminating requirement for superintendent to keep immunization records for home school students; modifying definition of a highly qualified teacher; specifying certain teaching and support personnel decisions; issuing teacher licenses to teachers from other states under certain circumstances; requiring school districts to provide certain education material and services to certain nonpublic schools; clarifying the requirements surrounding the formation of a charter school; requiring professionals to audit charter schools; specifying enforcement related to a cause for nonrenewal or termination of a charter school contract; specifying the issuing of instruction permits and employment certificates to home school students; directing the commissioner to convene a group assigned with improving differentiated graduation rates and exploring alternative routes to a standard diploma for at risk and off track students; directing commissioner to adopt on English language proficiency standards for limited English proficient (LEP) students; instructing assessment advisory committee to develop recommendations for alternative methods by which students satisfy the high school algebra end of course requirement; directing the commissioner to seek an exception from the federal government under the school improvement grant program related to the "persistently low achieving school" designation of a public school

ARTICLE 3 - SPECIAL PROGRAMS

Modifying the definition of child with a disability; modifying statutory language concerning the special instruction for children with a disability; resolving certain disputes relating to a child with disabilities whose district residence in question; requiring school districts to offer a conciliation conference in certain situations; requiring school districts to notify parents if they intend to seek third party reimbursement for medical assistance or MinnesotaCare for an individualized education program health related service; specifying the use of the reimbursements; clarifying informed consent and district disclosure of information provisions concerning children with disabilities; establishing the statewide hearing loss early education intervention coordinator; permitting parent to place an eligible child at the Minnesota academy for the deaf or Minnesota academy for the blind for a certain amount of time; requiring the redesigned medical assistance and MinnesotaCare enrollment forms distributed to schools include a form authorizing consent for third party billing

ARTICLE 4 - FACILITIES AND TECHNOLOGY

Authorizing procedure by which school districts can apply for health and safety revenue; allows school districts to qualify for health and safety revenue by adopting a health and safety policy; clarifying the calculation of health and safety revenue; modifying uses for health and safety revenue; specifying certain restrictions on health and safety revenue; requiring each health and safety revenue application to be accompanied by a description of each project for which funding is requested; specifying appeals process; prohibiting the department of education from requiring school districts to use specific management assistance services for health and safety projects; extending the capital lease authority for school districts that are members of the Technology and Information Education Systems (TIES) for ten or more years; authorizing Independent School District #284, Wayzata, to participate in the alternative facilities program for fiscal year 2013; allowing school districts who have not adopted a health and safety policy to submit an application for health and safety revenue

ARTICLE 5 - ACCOUNTING

Modifying school districts credit line and borrowing practices; clarifying that the commissioner can make an aid reduction to a school district that employs an unlicensed teacher; authorizing certain fund transfers for Independent School District #1, Aitkin, Independent School District #11, Anoka-Hennepin, Independent School District #728, Elk River, Independent School District #203, Hayfield, Independent School District #2172, Kenyon-Wanamingo, Independent School District #837, Madelia and Independent School District #283, St. Louis Park
