1.1A bill for an act 1.2relating to communications; setting state goals for the deployment and speed 1.3of high-speed broadband; requiring reports; proposing coding for new law in 1.4Minnesota Statutes, chapter 237. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6    Section 1. new text begin [237.012] BROADBAND GOALS.new text end 1.7    new text begin Subdivision 1.new text end new text begin Universal access and high-speed goal.new text end new text begin It is the goal of this state new text end 1.8new text begin that, no later than 2015, all state residents and businesses have access to broadband that new text end 1.9new text begin provides download speeds of no less than ten megabits per second and upload speeds new text end 1.10new text begin of no less than five megabits per second.new text end 1.11    new text begin Subd. 2.new text end new text begin State broadband leadership position.new text end new text begin It is the goal of this state that by new text end 1.12new text begin 2015, and continuing thereafter:new text end 1.13new text begin (1) the proportion of Minnesota residents and businesses having access to broadband new text end 1.14new text begin ranks among the five states in the United States and the 15 nations globally that have the new text end 1.15new text begin highest proportion of that measure; andnew text end 1.16new text begin (2) Minnesota ranks among the five states in the United States with the highest new text end 1.17new text begin broadband speed that is universally accessible to state residents and businesses.new text end 1.18    new text begin Subd. 3.new text end new text begin Annual reports.new text end new text begin By February 10, 2011, and each year thereafter, the new text end 1.19new text begin commissioner of commerce shall submit a report to the chairs and ranking minority new text end 1.20new text begin members of the house of representatives and senate committees with primary jurisdiction new text end 1.21new text begin over telecommunications policy measuring the progress made towards achieving the new text end 1.22new text begin goals under subdivisions 1 and 2. The report must identify any barriers impeding the new text end 1.23new text begin achievement of the goals, suggest strategies to overcome those barriers, and estimate new text end 1.24new text begin the cost of implementing those strategies.new text end 2.1    new text begin Subd. 4.new text end new text begin Advisory group.new text end new text begin By July 1, 2010, the commissioner of commerce shall new text end 2.2new text begin appoint and convene a broadband goal advisory group consisting of no more than 15 new text end 2.3new text begin members representing, at a minimum, the following sectors: providers of telephone, new text end 2.4new text begin cable, and wireless services; cities; counties; libraries; a labor organization representing new text end 2.5new text begin communications workers; and citizens-at-large. The commission shall meet at least new text end 2.6new text begin quarterly and shall seek public input. The broadband goal advisory group shall advise the new text end 2.7new text begin commissioner of commerce and the house of representatives and senate committees with new text end 2.8new text begin primary jurisdiction over telecommunications policy regarding strategies to achieve the new text end 2.9new text begin goals under subdivision 1. This subdivision expires June 30, 2015.new text end 2.10new text begin EFFECTIVE DATE.new text end new text begin This section is effective the day following final enactment.new text end
