1.1CONFERENCE COMMITTEE REPORT ON H. F. No. 2634 1.2A bill for an act 1.3relating to natural resources; expanding prohibitions on the appropriation of 1.4water from the Mt. Metzen 1.10President of the Senate 1.11We, the undersigned conferees for H. F. No. 2634 report that we have agreed upon 1.12the items in dispute and recommend as follows: 1.13That the Senate recede from its amendment and that H. F. No. 2634 be further 1.14amended as follows: 1.15Delete everything after the enacting clause and insert: 1.16    "Section 1. Minnesota Statutes 2008, section 103G.271, subdivision 4a, is amended to 1.17read: 1.18    Subd. 4a. Mt. Simon-Hinckley aquifer. (a) new text begin Except as provided in paragraph new text end 1.19 new text begin (b), new text end the commissioner may not issue new water use permits that will appropriate water 1.20from new text begin for new text end the Mt. Simon-Hinckley aquifer in a metropolitan county, as defined in section 1.21473.121, subdivision 4, unless the appropriation is for potable new text begin domestic new text end water use, there 1.22are no feasible or practical alternatives to this source, and a water conservation plan 1.23is incorporated with the permit. new text begin Domestic water uses include water used for general new text end 1.24 new text begin household purposes for essential human needs such as cooking, cleaning, drinking, new text end 1.25 new text begin washing, and waste disposal. new text end 1.26(b) The commissioner shall terminate all permits authorizing appropriation and 1.27use of water from the Mt. Simon-Hinckley aquifer for once-through systems in a 1.28metropolitan county, as defined in section 473.121, subdivision 4, by December 31, 1992. new text begin new text end 1.29 new text begin Notwithstanding paragraph (a), the commissioner may issue a new water use permit for new text end 2.1 new text begin the Mt. Simon-Hinckley aquifer for nondomestic use if there are no feasible or practical new text end 2.2 new text begin alternatives to the use of the aquifer, and water recycling and water conservation plans, new text end 2.3 new text begin as determined by the commissioner, are required under the permit. The commissioner new text end 2.4 new text begin shall ensure that a holder of a permit issued under this paragraph is implementing all new text end 2.5 new text begin water recycling and conservation plans required under the permit.
