1.1A bill for an act 1.2relating to elections; providing for transfer of general fund matching 1.3appropriations to the Help America Vote Act account. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5    Section 1. new text begin HELP AMERICA VOTE ACT. new text end 1.6 new text begin If the secretary of state determines that this state is otherwise eligible to receive new text end 1.7 new text begin an additional payment of federal money under the Help America Vote Act, Public Law new text end 1.8 new text begin 107-252, the secretary must certify to the commissioner of management and budget the new text end 1.9 new text begin amount, if any, needed to meet the matching requirement of section 253(b)(5) of the Help new text end 1.10 new text begin America Vote Act. In the certification, the secretary shall specify the portion of the match new text end 1.11 new text begin that should be taken from an unencumbered general fund appropriation to the Office of the new text end 1.12 new text begin Secretary of State not designated for a different purpose. Upon receipt of that certification, new text end 1.13 new text begin or as soon as an unencumbered general fund appropriation becomes available, whichever new text end 1.14 new text begin occurs later, the commissioner must transfer the specified amount to the Help America new text end 1.15 new text begin Vote Act account. new text end 1.16 new text begin This section expires on June 30, 2011. new text end 1.17 new text begin EFFECTIVE DATE. new text end new text begin This section is effective the day following final enactment. new text end
