relating to crimes; changing requirement that defendant waiver of jury trial be
consented to by prosecutor; proposing coding for new law in Minnesota Statutes,
chapter 631.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.

PROSECUTOR CONSENT.

The defendant may waive a jury on any issue with the approval of the courts and the
consent of the prosecutor. The court may accept a defendant's waiver of a jury on any
issue without the consent of the prosecutor, if the court finds that requiring a jury would
deprive the defendant of a fair trial.
