3E Relating to the organization, operation and financing of state government; modifying state and local government regulations; and appropriating money for general legislative and administrative expenses of state government

ARTICLE 1 - STATE GOVERNMENT APPROPRIATIONS

Providing a summary of appropriations; appropriating money to the legislature for the senate, house of representatives and legislative coordinating commission (LCC), for office of the revisor of statutes, legislative reference library, office of the legislative auditor, and a legislators forum, to governor and lieutenant governor, state auditor, attorney general, secretary of state, campaign finance and public disclosure board, investment board, office of enterprise and technology and requiring the development and implementation of a cost recovery plan, to the office of administrative hearings, to commissioner of administration for government and citizen services including the geospatial information office, council on developmental disabilities, 2010 census, office of the state archaeologist, certain office space costs of the legislature and veterans organizations, for administrative management support and for the office of grants management, providing a onetime cancellation for facilities repairs and replacement costs, providing for the continuation of planning for a data center consolidation, to capital area architectural and planning board, commissioner of finance, commissioner of revenue for tax system management and debt collection management, gambling control board, racing commission, state lottery board, for tort claims, Minnesota state retirement system (MSRS), Minneapolis employees retirement fund (MERF), teachers retirement association (TRA), St. Paul teachers retirement fund, Duluth teacher retirement fund, amateur sports commission, councils on Black Minnesotans, Chicano/Latino affairs, Asian-Pacific Minnesotans and the Indian affairs council, and for general contingent accounts; prohibiting certain out-of-state travel appropriation use; requiring certain fund transfers; appropriating money from the lottery prize fund to commissioner of human services (DHS) for a grant to the state affiliate recognized by the national council on problem gambling, requiring the affiliate to provide certain complimentary services to the DHS programs, specifying commissioner powers and contingency for nonstate matching funds, allowing commissioner of the Minnesota management and budget (MMB) (finance) to make disbursements upon receipt of matching funds; appropriating money obtained through indirect cost recovery to the commissioner of finance

ARTICLE 2 - STATE GOVERNMENT OPERATIONS

Extending the expiration date for legislative coordinating commission (LCC) authority for activities and duties related to ethnic heritage, cultural diversity and new Americans; modifying the definition of "employee of the state;" authorizing the legislative audit commission to review legislative auditor reports and make recommendations necessary for improvements of the states system of internal controls and financial management; modifying certain duties of the legislative auditor regarding the misuse of public money by state officials or employees; recreating the office of strategic and long-range planning as an independent agency of state government, designating the commissioner of administration as the state planning officer and specifying responsibility for coordination, development, assessment and communication of information, planning, policy and performance for the future, transferring responsibility for a long-range plan from the office to the commissioner, requiring report to the governor and legislature, authorizing the commissioner to appoint the state demographer, requiring the state demographer to release a demographic forecast in conjunction with the commissioner of Minnesota management and budget (MMB) (finance) November state economic forecast and to contract for the development of certain data and research, requiring the commissioner to review the statewide system and to provide a milestones report; regulating secretary of state business entity filings and fees, defining business entity, authorizing business entities e-mail (email) address collection, permitting fee charging for electronically transmitted document images, requiring on-line (online) business entities changes filing and charging a fee, extending the temporary technology surcharge, modifying certain annual renewal filing provisions for business entities, corporations, cooperatives, cooperative associations, nonprofit corporations, limited partnerships, foreign limited partnerships and limited liability companies; modifying the use of certain international student exchange visitor placement organization fees collected by the secretary of state, modifying the reporting and investigation procedure of complaints regarding an international student exchange organization; modifying the amount and the use of appropriations derived from the collection of state elections campaign fund money through income tax; modifying the powers and duties of the executive director of the Minnesota state board of investment; clarifying certain management and budget department (MMB) data oversight duties; changing the name of commissioner of finance to commissioner of management and budget; establishing the "Minnesota False Claims Act", prohibiting the intentional submission of false or fraudulent claims for payment or approval to an officer or employee of the state or a political subdivision, defining claim, imposing a civil penalty and liability for damages for violation, exceptions, authorizing and providing for investigation of violations by a prosecuting attorney, defining investigatory powers of attorney general, providing for private remedies, prohibiting actions against certain public officials, requiring action by the prosecuting attorney within a certain number of days following a complaint and disclosure, requiring complaints to be unsealed following action by the prosecuting attorney, findings or conclusions of law to be final, providing for the serving of unsealed complaints and response by the defendant and for certain additional actions to be taken by the prosecuting attorney, providing for stay of discovery and court imposed limits on participation of private plaintiffs, imposing a statute of limitations for actions and providing for certain remedies, prohibiting employers from imposing policies or rules forbidding employees to disclose information and from discriminatory acts for disclosure, imposing liability for damages for violation; specifying the deposit of net proceeds received by the state as the result of certain actions, establishing a false claims account in a special revenue fund of the state treasury; requiring attorney general to report to legislature regarding received complaints and staff issues; modifying duties of the commissioner of the department of management and budget; requiring the commissioner of management and budget in consultation with the commissioners of administration and revenue and the legislative auditor to maintain a web site with a searchable database providing the public with information on state contracts, state appropriations, state expenditures, tax expenditures and audits; requiring the commissioner to consult with the legislature; repealing current searchable web site database requirement for state contracts and grants; establishing a system of internal controls and internal auditing administered by the commissioner of the Minnesota management and budget, instructing commissioner to adopt certain internal control standards, authorize training and assistance of personnel and financial managers in state agencies, provide for the sharing of internal audit resources and monitor reports from the office of legislative auditor, requiring state agencies to budget for internal control systems and issue a report to the legislature concerning internal controls and internal auditing of executive agencies, specifying certain duties of the state agency heads, excluding the state colleges and university system; clarifying set rates for agency revolving funds for services, requiring state agencies to make certain deductions upon employee request; clarifying and strengthening provisions prohibiting misuse of public money in the executive branch of state government; allowing the management and budget (MMB) department to recover and deposit in the general fund any amount of settlement or recovery of funds; requiring the commissioner of management and budget (MMB) to periodically review the formula used to estimate the percentage of the preceding biennium general fund expenditures and transfers recommended as a budget reserve; providing for management and budget (MMB) technology development lease-purchase financing and appropriating money to the commissioner; allowing state executive, legislative or judicial branch entities to use proprietary space to offer fitness, wellness or similar classes or activities to employees, permitting participation fee charging by instructors, providing a general application to state space in the state capitol area and other designated areas as defined by rules adopted by commissioner of public safety; requiring lights in state buildings to be off during certain times to reduce dangers posed to migrating birds; establishing the geospatial information office, specifying certain responsibilities and authority of the office, prescribing certain duties of the office, establishing duties of the chief geospatial information officer, establishing certain discretionary powers of the office, authorizing the formation of a statewide geospatial advisory council and a state government geospatial advisory council to provide recommendations for improving the operations and management of geospatial technology within the state government and issues of importance to users of geospatial technology throughout the state, sunset provision, requiring a report to the legislature by a certain date, authorizing the transfer of all existing funds, assets, employees, equipment and supplies from the land management information center to the Minnesota geospatial information office; authorizing the commissioner of administration to award a certain amount of preferences in the amount bid on state procurement to certified small businesses majority-owned and operated by veterans or veterans with service connected disabilities; creating a statewide electronic licensing account for completion of the Minnesota electronic licensing system; expanding the number of hours state employees may donate to the vacation donation program, specifying certain conditions and limitations; providing additional sick leave for qualifying state employee veterans with service-related disabilities for treatment purposes under certain conditions; requiring commissioner of management and budget (MMB) to develop and make available to appointing authorities a best practices policy for conducting investigations of certain inappropriate activities; modifying and clarifying certain provisions concerning voluntary unpaid leave of absence; establishing the management analysis revolving fund in the state treasury, providing for appropriation and use of funds for providing services to state agencies, local units of government, metropolitan and regional agencies, school districts and other public entities, specifying reimbursement requirements, certain cash flow duties and liquidation procedures; authorizing the commissioner of management and budget (MMB) to transfer a certain amount of money from the commerce department technology account to the statewide electronic licensing system account; authorizing the commissioner of transportation (DOT) to award a certain amount of preferences in the amount bid for specified trunk highway construction to certain veteran-owned small businesses; appropriating money to the commissioner of management and budget (MMB) for the purpose of making payments under the technology lease-purchase agreement; increasing department of revenue lien fees and specifying fee for electronic images, making optional the secretary of state annual renewal notice to corporations, adding a limited partnership name reservation filing fee, increasing certain fees, changing the terms of assumed names certificate filings and renewal; requiring the consent of a town board within Hennepin county before the Three Rivers Park district acquires property in the town; modifying certain required components and accounting and financial reporting requirements of tax increment financing plans; requiring municipalities to contract for purchases by using contracts available through the state cooperative purchasing venture; requiring the metropolitan council to award a certain percentage of preference in the amount bid for specified goods and services to veteran-owned small businesses; extending the availability of an appropriation for optical scan voting equipment; extending the Victory Memorial Drive historic district task force sunset; requiring the commissioner of public safety to modify certain rules to comply with the requirement to offer employee fitness and wellness facilities; ratifying Minnesota racing commission racing license fees; requiring executive branch agencies to consider using services provided by government training services before contracting with other outside vendors for similar services; requiring the commissioner of administration to report to the legislature regarding certain rental cost savings; requiring the commissioner of finance to report to the legislature regarding the cash flow condition of the general fund; requiring the management analysis division of the department of finance to report to the legislature on the possible collocation of the offices of the Council on Black Minnesotans, the Council on Affairs of Chicano/Latino People, the Council on Asian-Pacific Minnesotans and the metropolitan area office of the Indian Affairs Council; authorizing the transfer of all existing funds, assets, employees, equipment and supplies from the land management information center to the Minnesota geospatial information office; authorizing lease-purchase agreements and appropriating proceeds to the management and budget office (MMB) for the new statewide accounting and procurement system and appropriating proceeds to commissioner of revenue for an integrated tax software package; requiring the chief information officer of the office of enterprise technology, in consultation with heads of other executive agencies, to report to the legislature on a plan to transfer certain employees from other agencies to the office of enterprise technology; requiring the commissioner of administration to determine the amount to be contributed by each executive agency to maintain the enterprise real property technology system; instructing the revisor to substitute the terms "Land Management Information Center" with "Minnesota Geospatial Information Office," "United States Information Agency" with "Office of Exchange Coordination and Designation, United States Department of State," and "Department of Finance" with the "Department of Management and Budget;" repealing a certain annual general fund appropriation to the metropolitan amateur sports commission, certain city and county pay equity compliance report requirements, the existence of the land management information center, a current searchable web site database requirement for state contracts and grants; specifying that certain statutes concerning small business provisions be repealed if the House omnibus agriculture and veterans affairs bill passes with certain language relating to veteran-owned businesses
