4E Relating to human services

ARTICLE 1 - DATA PRACTICES
Providing for the use of personal home contact information in the event of an emergency or other disruption affecting the continuity of operation of a government entity; requiring private personnel data of state employees to be disclosed to the department of administration for purposes of administering the workers' compensation program; including human services applicant data in government data; making public the identity data on certain persons with licensing sanctions or denials under certain conditions; maintaining confidentiality for reporters with complaints or alleged violations of licensing standards and alleged maltreatment; making clarifying changes; prohibiting disclosure of maltreatment or licensing violation reporter identities

ARTICLE 2 - LICENSING

Modifying certain provisions governing the licensing of respiratory therapists; defining and redefining certain terms; broadening certain general requirements for licensure qualification purposes; modifying scope of practice provisions; modifying certain protected titles and restrictions on use; prohibiting unlicensed practice; modifying renewal requirements; renaming the respiratory care practitioner advisory council to the respiratory care advisory council; exempting certain licensed group residential facilities from department of health food, beverage and lodging establishment regulations; modifying department of human services day treatment time block requirements and removing the requirement for children's day treatment services inclusion as an integrated set of education, therapy and family interventions and modifying an availability requirement; exempting YMCA, YWCA and JCC programs, certain private practice professionally licensed chemical dependency and substance abuse counselor activities, and certain accredited programs serving children age 33 months or older operated by a nonpublic school from department of human services (DHS) licensing requirements, specifying certain accreditation requirements, ensuring processing of child care center licensure applications for excluded providers; prohibiting licensing for persons with outstanding DHS fees; requiring license holder electronic records maintenance; expanding denial of application to controlling individuals and certain persons in the household, specifying time limit for appeals; allowing commissioner revocation and suspension for sanctions and permitting certain continuance; specifying parent directives contents and clarifying requirements application for sudden infant death syndrome (SIDS) in licensed programs, specifying certain staff training and documentation requirements; providing for day training and habilitation or supported employment services programs, providing for programs with three-year accreditation, providing for investigations of alleged maltreatment of minors or vulnerable adults, requiring commissioner to submit a request to commission of rehabilitation facilities to expand accreditation survey; prohibiting variances for maximum allowable family child care license capacity; clarifying SIDS training requirements; requiring license holders to provide commissioner notice through the online background study system or via letter under certain conditions, requiring multiple programs license holders to notify commissioner regarding staffing changes upon closure of a program; clarifying and modifying certain background studies requirements; modifying county agency background study requirements and background studies pending completion; defining disqualification based on an Alford Plea; modifying disqualification provisions; adding criminal vehicular operation causing death to disqualification conditions; allowing commissioner to grant a variance for licensed foster care providers adopting certain persons requiring background studies; modifying child foster care licensing consolidated reconsideration; modifying certain children's therapeutic services provisions relating to the definition of day treatment services for medical assistance (MA) purposes, provider entity certification and clinical infrastructure requirements and certain service delivery criteria; expanding general assistance (GA) standards for special needs recipients of home and community-based services for relocation purposes; modifying the definition of neglect; requiring both individuals and facility license holders to be held responsible for maltreatment under certain conditions; clarifying department of health responsibility for residential facilities federally certified as intermediate care facilities serving persons with development disabilities; repealing commissioner of human services background study fees
