1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2008, section 116.76, subdivision 18, is amended to read:
1.7 Subd. 18. Sharps. "Sharps" means:
1.8(1) discarded items that can induce subdermal inoculation of infectious agents,
1.9including needlesnew text begin , lancetsnew text end , scalpel blades, pipettes, and other items derived from human
1.10or animal patient care, blood banks, laboratories, mortuaries, research facilities, and
1.11industrial operations; and
1.12(2) discarded glass or rigid plastic vials containing infectious agents.
1.13 Sec. 2. new text begin [116.835] SAFE SHARPS MANAGEMENT.new text end
1.14new text begin (a) A pharmaceutical manufacturer that sells or distributes a medication in new text end
1.15new text begin Minnesota that is usually intended to be self-injected in a home resulting in the generation new text end
1.16new text begin of sharps shall, on or before July 1, 2011, and annually thereafter, submit to the Pollution new text end
1.17new text begin Control Agency a plan that describes how the manufacturer supports the safe collection new text end
1.18new text begin and proper disposal of the sharps.new text end
1.19new text begin (b) The plan required under paragraph (a) shall include, at a minimum, a description new text end
1.20new text begin of the actions, if any, taken by the manufacturer to do the following:new text end
1.21new text begin (1) provide for the safe collection and proper disposal of sharps;new text end
1.22new text begin (2) educate consumers about safe management and collection opportunities; and new text end
2.1new text begin (3) support efforts by retailers, pharmaceutical distributors, manufacturers of sharps, new text end
2.2new text begin local governments, health care organizations, public health officers, solid waste service new text end
2.3new text begin providers, and other groups with interest in protecting public health and safety through the new text end
2.4new text begin sale, collection, and proper disposal of sharps.new text end
2.5new text begin (c) The manufacturer must post and maintain a copy of the plans required under new text end
2.6new text begin paragraph (a) on its Web site.new text end
2.7new text begin (d) The commissioner of the Pollution Control Agency must post and maintain new text end
2.8new text begin copies of plans submitted by manufacturers on the Pollution Control Agency Web site.new text end
2.9new text begin (e) For purposes of this section, "sharps" has the meaning given in section 116.76, new text end
