1.1A bill for an act 1.2relating to commerce; prohibiting certain unfair ticket sales;proposing coding 1.3for new law in Minnesota Statutes, chapter 609. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5    Section 1. new text begin [609.807] EVENT TICKETS; PROHIBITED ACTS.new text end 1.6new text begin (a) As used in this section: (1) "initial seller" means a person or entity with whom new text end 1.7new text begin a provider of an event or venue has contracted for the sale of tickets for the purpose new text end 1.8new text begin of the initial sale of those tickets to the general public; and (2) "ticket" means a ticket new text end 1.9new text begin of admission to a sporting event, theater, musical performance, or place of public new text end 1.10new text begin entertainment or amusement of any kind.new text end 1.11new text begin (b) The initial seller of tickets shall make available for sale all tickets under control new text end 1.12new text begin of the initial seller in the manner and under terms directed by the provider of the event new text end 1.13new text begin or venue. The initial seller shall not, unless authorized by the provider of the event or new text end 1.14new text begin venue, divert tickets from the initial sale to the general public to be sold in any other new text end 1.15new text begin manner or under any other terms.new text end 1.16new text begin (c) No person or entity, with intent to defraud, may sell or offer for sale a ticket that new text end 1.17new text begin is invalid, counterfeit, altered, or otherwise not genuine.new text end 1.18new text begin (d) A violation of this section is a misdemeanor.new text end 1.19new text begin EFFECTIVE DATE.new text end new text begin This section is effective August 1, 2009, and applies to new text end 1.20new text begin offenses committed on or after that date.new text end
