1.13new text begin microorganisms on human skin or mucosa.new text end
1.14 new text begin Subd. 4.new text end new text begin Body art.new text end new text begin "Body art" or "body art procedures" means physical body new text end
1.15new text begin adornment using, but not limited to, tattooing and body piercing. Body art does not include new text end
1.16new text begin practices and procedures that are performed by a licensed medical or dental professional if new text end
1.17new text begin the procedure is within the professional's scope of practice.new text end
1.18 new text begin Subd. 5.new text end new text begin Body art establishment.new text end new text begin "Body art establishment" or "establishment" new text end
1.19new text begin means any structure or venue, whether permanent, temporary, or mobile, where body art new text end
1.20new text begin is performed. Mobile establishments include vehicle-mounted units, either motorized or new text end
1.21new text begin trailered, and readily moveable without dissembling and where body art procedures are new text end
1.22new text begin regularly performed in more than one geographic location.new text end
1.23 new text begin Subd. 6.new text end new text begin Body piercing.new text end new text begin "Body piercing" means the penetration or puncturing of new text end
1.24new text begin the skin by any method for the purpose of inserting jewelry or other objects in or through new text end
1.25new text begin the body. Body piercing also includes branding, scarification, suspension, subdermal new text end
2.1new text begin implantation, microdermal, and tongue bifurcation. Body piercing does not include the new text end
2.2new text begin piercing of the outer perimeter or the lobe of the ear using a presterilized single-use new text end
2.3new text begin stud-and-clasp ear-piercing system.new text end
2.4 new text begin Subd. 7.new text end new text begin Branding.new text end new text begin "Branding" means an indelible mark burned into the skin using new text end
2.5new text begin instruments of thermal cautery, radio hyfrecation, and strike branding.new text end
2.6 new text begin Subd. 8.new text end new text begin Commissioner.new text end new text begin "Commissioner" means the commissioner of health.new text end
2.7 new text begin Subd. 9.new text end new text begin Contaminated waste.new text end new text begin "Contaminated waste" means any liquid or new text end
2.8new text begin semiliquid blood or other potentially infectious materials; contaminated items that would new text end
2.9new text begin release blood or other potentially infectious materials in a liquid or semiliquid state new text end
2.10new text begin if compressed; items that are caked with dried blood or other potentially infectious new text end
2.11new text begin materials and are capable of releasing these materials during handling; and sharps and any new text end
2.12new text begin wastes containing blood and other potentially infectious materials, as defined in Code of new text end
2.13new text begin Federal Regulations, title 29, section 1910.1030, known as "Occupational Exposure to new text end
2.14new text begin Bloodborne Pathogens."new text end
2.15 new text begin Subd. 10.new text end new text begin Department.new text end new text begin "Department" means the Department of Health.new text end

2.17new text begin containers, vessels, tools, devices, implements, furniture, display and storage areas, sinks, new text end

2.19 new text begin Subd. 12.new text end new text begin Guest artist.new text end new text begin "Guest artist" means an individual who performs body art new text end
2.20new text begin procedures according to the requirements under section 146B.04.new text end
2.21 new text begin Subd. 13.new text end new text begin Hand sink.new text end new text begin "Hand sink" means a sink equipped with potable hot and new text end
2.22new text begin cold water held under pressure, used for washing hands, wrists, arms, or other portions of new text end
2.23new text begin the body.new text end
2.24 new text begin Subd. 14.new text end new text begin Hot water.new text end new text begin "Hot water" means water at a temperature of at least 110 new text end

2.28new text begin tuberculocidal disinfectant or sanitizer registered with the Environmental Protection new text end

2.31new text begin body part other than an earlobe for the purpose of inserting an anchor with a step either new text end

2.33 new text begin Subd. 18.new text end new text begin Micropigmentation or cosmetic tattooing.new text end new text begin "Micropigmentation or new text end
2.34new text begin cosmetic tattooing" means the use of tattoos for permanent makeup or to hide or neutralize new text end
2.35new text begin skin discolorations.new text end
3.1 new text begin Subd. 19.new text end new text begin Operator.new text end new text begin "Operator" means any person who controls, operates, or new text end
3.2new text begin manages body art activities at a body art establishment and who is responsible for the new text end
3.3new text begin establishment's compliance with these regulations, whether or not the person actually new text end
3.4new text begin performs body art activities.new text end
3.5 new text begin Subd. 20.new text end new text begin Procedure area.new text end new text begin "Procedure area" means the physical space or room new text end
3.6new text begin used for conducting body art procedures.new text end
3.7 new text begin Subd. 21.new text end new text begin Procedure surface.new text end new text begin "Procedure surface" means the surface area of new text end
3.8new text begin furniture or accessories that may come into contact with the client's clothed or unclothed new text end
3.9new text begin body during a body art procedure and the area of the client's skin where the body art new text end
3.10new text begin procedure is to be performed and the surrounding area, or any other associated work new text end
3.11new text begin area requiring sanitizing.new text end
3.12 new text begin Subd. 22.new text end new text begin Scarification.new text end new text begin "Scarification" means an indelible mark fixed on the new text end
3.13new text begin body by the production of scars.new text end
3.14 new text begin Subd. 23.new text end new text begin Sharps.new text end new text begin "Sharps" means any object, sterile or contaminated, that may new text end
3.15new text begin purposefully or accidentally cut or penetrate the skin or mucosa including, but not limited new text end
3.16new text begin to, presterilized single-use needles, scalpel blades, and razor blades.new text end
3.17 new text begin Subd. 24.new text end new text begin Sharps container.new text end new text begin "Sharps container" means a closed, puncture-resistant, new text end
3.18new text begin leak-proof container, labeled with the international biohazard symbol, that is used for new text end
3.19new text begin handling, storage, transportation, and disposal.new text end
3.20 new text begin Subd. 25.new text end new text begin Single use.new text end new text begin "Single use" means products or items intended for onetime new text end
3.21new text begin use which are disposed of after use on a client. This definition includes, but is not limited new text end
3.22new text begin to, cotton swabs or balls, tissues or paper products, paper or plastic cups, gauze and new text end
3.23new text begin sanitary coverings, disposable razors, piercing needles, tattoo needles, scalpel blades, new text end
3.24new text begin stencils, ink cups, and protective gloves.new text end
3.25 new text begin Subd. 26.new text end new text begin Sterilization.new text end new text begin "Sterilization" means a process resulting in the destruction new text end
3.26new text begin of all forms of microbial life, including highly resistant bacterial spores.new text end
3.27 new text begin Subd. 27.new text end new text begin Subdermal implantation.new text end new text begin "Subdermal implantation" means the new text end
3.28new text begin implantation of an object entirely below the dermis.new text end
3.29 new text begin Subd. 28.new text end new text begin Supervision.new text end new text begin "Supervision" means the physical presence of a technician new text end
3.30new text begin licensed under this chapter while a body art procedure is being performed.new text end
3.31 new text begin Subd. 29.new text end new text begin Suspension.new text end new text begin "Suspension" means the suspension of the body from affixed new text end
3.32new text begin hooks placed through temporary piercings.new text end
3.33 new text begin Subd. 30.new text end new text begin Tattooing.new text end new text begin "Tattooing" means any method of placing indelible ink or new text end
3.34new text begin other pigments into or under the skin or mucosa with needles or any other instruments used new text end
3.35new text begin to puncture the skin, resulting in permanent coloration of the skin or mucosa. Tattooing new text end
3.36new text begin also includes micropigmentation and cosmetic tattooing.new text end
4.1 new text begin Subd. 31.new text end new text begin Technician.new text end new text begin "Technician" or "body art technician" means any individual new text end
4.2new text begin who is licensed under this chapter as a tattoo technician or as a body piercing technician new text end
4.3new text begin or as both.new text end
4.4 new text begin Subd. 32.new text end new text begin Temporary body art establishment.new text end new text begin "Temporary body art establishment" new text end
4.5new text begin means any place or premise operating at a fixed location where an operator performs body new text end
4.6new text begin art procedures for no more than 21 days in conjunction with a single event or celebration.new text end
4.7 new text begin Subd. 33.new text end new text begin Tongue bifurcation.new text end new text begin "Tongue bifurcation" means the cutting of the new text end
4.8new text begin tongue from the tip to the base, forking at the end.new text end
4.9 Sec. 2. new text begin [146B.02] ESTABLISHMENT LICENSE PROCEDURES.new text end
4.10 new text begin Subdivision 1.new text end new text begin General.new text end new text begin Beginning January 1, 2011, no person acting individually new text end
4.11new text begin or jointly with any other person may maintain, own, or operate a body art establishment in new text end
4.12new text begin the state without an establishment license issued by the commissioner in accordance with new text end
4.13new text begin this chapter, except as permitted under subdivision 8 or 9.new text end
4.14 new text begin Subd. 2.new text end new text begin Requirements.new text end new text begin (a) Each application for an initial establishment license new text end
4.15new text begin and for renewal must be submitted to the commissioner on a form provided by the new text end
4.16new text begin commissioner accompanied with the applicable fee required under section 146B.10. The new text end
4.17new text begin application must contain:new text end
4.18new text begin (1) the name(s) of the owner(s) and operator(s) of the establishment;new text end
4.19new text begin (2) the location of the establishment;new text end
4.20new text begin (3) verification of compliance with all applicable local and state codes;new text end
4.21new text begin (4) a description of the general nature of the business; andnew text end
4.22new text begin (5) any other relevant information deemed necessary by the commissioner.new text end
4.23 new text begin (b) The commissioner shall issue a provisional establishment license effective until new text end
4.24new text begin the commissioner determines after inspection that the applicant has met the requirements new text end
4.25new text begin of this chapter. Upon approval, the commissioner shall issue a body art establishment new text end
4.26new text begin license effective for three years.new text end
4.27 new text begin Subd. 3.new text end new text begin Inspection.new text end new text begin (a) Within the period of the provisional establishment license, new text end
4.28new text begin and thereafter at least one time during each three-year licensure period, the commissioner new text end
4.29new text begin shall conduct an inspection of the body art establishment and a review of any records new text end
4.30new text begin necessary to ensure that the standards required under this chapter are met.new text end
4.31 new text begin (b) The commissioner shall have the authority to enter a premises to make an new text end
4.32new text begin inspection. Refusal to permit an inspection constitutes valid grounds for licensure denial new text end
4.33new text begin or revocation.new text end
5.1 new text begin (c) If the establishment seeking licensure is new construction or if a licensed new text end
5.2new text begin establishment is remodeling, the establishment must meet all local building and zoning new text end
5.3new text begin codes.new text end
5.4 new text begin Subd. 4.new text end new text begin Location restricted.new text end new text begin No person may perform a body art procedure at new text end
5.5new text begin any location other than a body art establishment licensed under this chapter except as new text end
5.6new text begin permitted under subdivisions 8 and 9.new text end
5.7 new text begin Subd. 5.new text end new text begin Transfer and display of license.new text end new text begin A body art establishment license must new text end
5.8new text begin be issued to a specific person and location and is not transferable. A license must be new text end
5.9new text begin prominently displayed in a public area of the establishment.new text end
5.10 new text begin Subd. 6.new text end new text begin Establishment information.new text end new text begin The following information must be kept on new text end
5.11new text begin file for three years on the premises of the establishment and must be made available for new text end
5.12new text begin inspection upon request by the commissioner:new text end
5.13new text begin (1) a description of all body art procedures performed by the establishment; new text end
5.14new text begin (2) copies of the spore tests conducted on each sterilizer; andnew text end
5.15new text begin (3) the following information for each technician or guest artist employed or new text end
5.16new text begin performing body art procedures in the establishment:new text end
5.17new text begin (i) name;new text end
5.18new text begin (ii) home address;new text end
5.19new text begin (iii) home telephone number;new text end
5.20new text begin (iv) date of birth;new text end
5.21new text begin (v) copy of an identification photo; andnew text end
5.22new text begin (vi) license number or guest artist license number.new text end
5.23 new text begin Subd. 7.new text end new text begin Establishments located in a private residence.new text end new text begin If the body art new text end
5.24new text begin establishment is located within a private residence, the space where the body art new text end
5.25new text begin procedures are performed must:new text end
5.26 new text begin (1) be completely partitioned off;new text end
5.27 new text begin (2) be exclusively used for body art procedures;new text end
5.28 new text begin (3) be separate from the residential living, eating, and bathroom areas; new text end
5.29 new text begin (4) have an entrance separate from the entrance to the residential area;new text end
5.30 new text begin (5) meet the standards of this chapter; andnew text end
5.31 new text begin (6) be made available for inspection upon the request of the commissioner.new text end
5.32 new text begin Subd. 8.new text end new text begin Temporary events permit.new text end new text begin (a) An owner or operator of a temporary new text end
5.33new text begin body art establishment shall submit an application for a temporary events permit to the new text end
5.34new text begin commissioner at least 14 days before the start of the event. The application must include new text end
5.35new text begin the specific days and hours of operation. The owner or operator shall comply with the new text end
5.36new text begin requirements of this chapter.new text end
6.1new text begin (b) The temporary events permit must be prominently displayed in a public area new text end
6.2new text begin at the location.new text end
6.3new text begin (c) The temporary events permit, if approved, is valid for the specified dates and new text end
6.4new text begin hours listed on the application. No temporary events permit shall be issued for longer than new text end
6.5new text begin a 21-day period, and may not be extended.new text end
6.6 new text begin Subd. 9.new text end new text begin Exception.new text end new text begin (a) Any body art establishment located within a county or new text end
6.7new text begin municipal jurisdiction that has enacted an ordinance that establishes licensure for body art new text end
6.8new text begin establishments operating within the jurisdiction shall be exempt from this chapter if the new text end
6.9new text begin provisions of the ordinance meet or exceed the provisions of this chapter. Any county or new text end
6.10new text begin municipal jurisdiction that maintains an ordinance that meets this exception may limit the new text end
6.11new text begin types of body art procedures that may be performed in body art establishments located new text end
6.12new text begin within its jurisdiction.new text end
6.13 new text begin (b) Any individual performing body art procedures in an establishment that meets new text end
6.14new text begin an exception under this subdivision must be licensed as a body art technician under this new text end
6.15new text begin chapter.new text end
6.16 Sec. 3. new text begin [146B.03] LICENSURE FOR BODY ART TECHNICIANS.new text end
6.17 new text begin Subdivision 1.new text end new text begin Licensure required.new text end new text begin (a) Effective January 1, 2011, no individual new text end
6.18new text begin may perform tattooing unless the individual holds a valid tattoo technician license issued new text end
6.19new text begin by the commissioner under this chapter, except as provided in subdivision 3.new text end
6.20 new text begin (b) Effective January 1, 2011, no individual may perform body piercing unless the new text end
6.21new text begin individual holds a valid body piercing technician license issued by the commissioner new text end
6.22new text begin under this chapter, except as provided in subdivision 3.new text end
6.23 new text begin (c) If an individual performs both tattooing and body piercing, the individual must new text end
6.24new text begin hold a valid dual body art technician license.new text end
6.25 new text begin Subd. 2.new text end new text begin Designation.new text end new text begin (a) No individual may use the title of "tattooist," "tattoo new text end
6.26new text begin artist," "tattoo technician," "body art practitioner," "body art technician," or other letters, new text end
6.27new text begin words, or titles in connection with that individual's name which in any way represents that new text end
6.28new text begin the individual is engaged in the practice of tattooing or authorized to do so, unless the new text end
6.29new text begin individual is licensed and authorized to perform tattooing under this chapter.new text end
6.30 new text begin (b) No individual may use the title "body piercer," "body piercing artist," "body art new text end
6.31new text begin practitioner," "body art technician," or other letters, words, or titles in connection with new text end
6.32new text begin that individual's name which in any way represents that the individual is engaged in the new text end
6.33new text begin practice of body piercing or authorized to do so, unless the individual is licensed and new text end
6.34new text begin authorized to perform body piercing under this chapter.new text end
7.1 new text begin (c) Any representation made to the public by a licensed technician must specify the new text end
7.2new text begin types of body art procedures the technician is licensed to perform.new text end
7.3 new text begin Subd. 3.new text end new text begin Exceptions.new text end new text begin (a) The following individuals may perform body art new text end
7.4new text begin procedures within the scope of their practice without a technician's license:new text end
7.5new text begin (1) a physician licensed under chapter 147; new text end
7.6new text begin (2) a nurse licensed under sections 148.171 to 148.285; new text end
7.7new text begin (3) a chiropractor licensed under chapter 148; new text end
7.8new text begin (4) an acupuncturist licensed under chapter 147B; new text end
7.9new text begin (5) a physician's assistant licensed under chapter 147A; or new text end
7.10new text begin (6) a dental professional licensed under chapter 150A.new text end
7.11new text begin (b) A guest artist under section 146B.04 may perform body art procedures in new text end
7.12new text begin accordance with the requirements of section 146B.04.new text end
7.13 new text begin Subd. 4.new text end new text begin Licensure requirements.new text end new text begin An applicant for licensure under this section new text end
7.14new text begin shall submit to the commissioner on a form provided by the commissioner:new text end
7.15new text begin (1) proof that the applicant is over the age of 18; new text end
7.16 new text begin (2) the type of license the applicant is applying for;new text end
7.17new text begin (3) all fees required under section 146B.10; new text end
7.18new text begin (4) proof of completing a minimum of 200 hours of supervised experience within new text end
7.19new text begin the area for which the applicant is seeking a license, and must include an affidavit from the new text end
7.20new text begin supervising licensed technician;new text end
7.21new text begin (5) proof of having satisfactorily completed coursework approved by the new text end
7.22new text begin commissioner on bloodborne pathogens, the prevention of disease transmission, infection new text end
7.23new text begin control, and aseptic technique. Courses to be considered for approval by the commissioner new text end
7.24new text begin may include, but are not limited to, those administered by one of the following:new text end
7.25new text begin (i) the American Red Cross;new text end
7.26new text begin (ii) United States Occupational Safety and Health Administration (OSHA); or new text end
7.27new text begin (iii) the Alliance of Professional Tattooists; and new text end
7.28new text begin (6) any other relevant information requested by the commissioner.new text end
7.29 new text begin Subd. 5.new text end new text begin Action on licensure applications.new text end new text begin (a) The commissioner shall notify the new text end
7.30new text begin applicant in writing of the action taken on the application. If the application is approved, new text end
7.31new text begin the commissioner shall issue a tattoo technician license, a body piercing technician new text end
7.32new text begin license, or a dual body art technician license.new text end
7.33 new text begin (b) If licensure is denied, the applicant must be notified of the determination and new text end
7.34new text begin the grounds for it, and the applicant may request a hearing under chapter 14 on the new text end
7.35new text begin determination by filing a written statement with the commissioner within 30 days after new text end
8.1new text begin receipt of the notice of denial. After the hearing, the commissioner shall notify the new text end
8.2new text begin applicant in writing of the decision.new text end
8.3 new text begin Subd. 6.new text end new text begin Licensure term; renewal.new text end new text begin (a) A technician's license is valid for two new text end
8.4new text begin years from the date of issuance and may be renewed upon payment of the renewal fee new text end
8.5new text begin established under section 146B.10.new text end
8.6new text begin (b) At renewal, a licensee must submit proof of continuing education approved by new text end
8.7new text begin the commissioner in the areas identified in subdivision 4, clause (5).new text end
8.8 new text begin Subd. 7.new text end new text begin Temporary licensure.new text end new text begin (a) The commissioner may issue a temporary new text end
8.9new text begin license to an applicant who submits to the commissioner on a form provided by the new text end
8.10new text begin commissioner:new text end
8.11new text begin (1) proof that the applicant is over the age of 18;new text end
8.12new text begin (2) all fees required under section 148B.10; andnew text end
8.13new text begin (3) a letter from a licensed technician who has agreed to provide the supervision to new text end
8.14new text begin meet the supervised experience requirement under subdivision 4, clause (4).new text end
8.15new text begin (b) Upon completion of the required supervised experience, the temporary new text end
8.16new text begin licensee shall submit documentation of satisfactorily completing the requirements under new text end
8.17new text begin subdivision 4, clauses (3) and (4), and the applicable fee under section 146B.10. The new text end
8.18new text begin commissioner shall issue a new license in accordance with subdivision 4.new text end
8.19new text begin (c) A temporary license issued under this subdivision is valid for one year and new text end
8.20new text begin may be renewed for one additional year.new text end
8.21 new text begin Subd. 8.new text end new text begin License by reciprocity.new text end new text begin The commissioner shall issue a technician's license new text end
8.22new text begin to a person who holds a current license, certification, or registration from another state if new text end
8.23new text begin the commissioner determines that the standards for licensure, certification, or registration new text end
8.24new text begin in the other jurisdiction meet or exceed the requirements for licensure stated in this chapter new text end
8.25new text begin and a letter is received from that jurisdiction stating that the applicant is in good standing.new text end
8.26 new text begin Subd. 9.new text end new text begin Transfer and display of license.new text end new text begin A license issued under this section is not new text end
8.27new text begin transferable to another individual. A valid license must be displayed at the establishment new text end
8.28new text begin site and available to the public upon request.new text end
8.29 new text begin Subd. 10.new text end new text begin Transition period.new text end new text begin Until January 1, 2012, the supervised experience new text end
8.30new text begin requirement under subdivision 4, clause (4), shall be waived by the commissioner if the new text end
8.31new text begin applicant submits to the commissioner evidence satisfactory to the commissioner that the new text end
8.32new text begin applicant has performed at least 2,080 hours within the last five years in the body art area new text end
8.33new text begin in which the applicant is seeking licensure.new text end
8.34 Sec. 4. new text begin [146B.04] TEMPORARY LICENSURE FOR GUEST ARTISTS.new text end
9.1 new text begin Subdivision 1.new text end new text begin General.new text end new text begin Before an individual may work as a guest artist, the new text end
9.2new text begin commissioner shall issue a temporary license to the guest artist. The guest artist shall new text end
9.3new text begin submit an application to the commissioner on a form provided by the commissioner. new text end
9.4new text begin The form must include:new text end
9.5new text begin (1) the name, home address, and date of birth of the guest artist;new text end
9.6new text begin (2) the name of the licensed technician sponsoring the guest artist; new text end
9.7 new text begin (3) proof of having satisfactorily completed coursework approved by the new text end
9.8new text begin commissioner on bloodborne pathogens, the prevention of disease transmission, infection new text end
9.9new text begin control, and aseptic technique;new text end
9.10new text begin (4) the starting and anticipated completion dates the guest artist will be working; andnew text end
9.11new text begin (5) a copy of any current body art credential or licensure issued by another local new text end
9.12new text begin or state jurisdiction.new text end
9.13 new text begin Subd. 2.new text end new text begin Guest artists.new text end new text begin A guest artist may not conduct body art procedures for more new text end
9.14new text begin than 30 days per calendar year. If the guest artist exceeds this time period, the guest artist new text end
9.15new text begin must apply for a technician's license under section 146B.03.new text end
