A bill for an act
relating to real estate; prohibiting discontinuance of investigations of residential
building contractors due to the homeowner making a warranty claim; amending
Minnesota Statutes 2008, section 326B.082, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2008, section 326B.082, is amended by adding a
subdivision to read:

The commissioner shall
not refuse to begin, discontinue, delay, or terminate an investigation, administrative
proceeding, or other action involving an alleged violation by a residential building
contractor on the grounds that a warranty claim under chapter 327A has been made or
that an action based on such a claim has been commenced.
