A bill for an act
proposing an amendment to the Minnesota Constitution, article XIII, by adding
a section; providing authority to the Minnesota Public Utilities Commission,
or its successor, to issue a certificate of need for the construction of a nuclear
electric generating plant.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

NUCLEAR MORATORIUM.

An amendment to the Minnesota Constitution is proposed to the people. If the
amendment is adopted, a section shall be added to article XIII, to read:

The Minnesota Public Utilities Commission, or its successor, has authority to
issue a certificate of need for the construction of a nuclear electric generating plant.

The proposed amendment must be submitted to the people at the 2010 general
election. The question submitted must be:

"Shall the Minnesota Constitution be amended to grant authority to the Minnesota
Public Utilities Commission, or its successor, to issue a certificate of need for the
construction of a nuclear electric generating plant?
