1.1A bill for an act 1.2relating to occupations and professions; regulating the practice of plumbing; 1.3regulating work on medical gas systems;proposing coding for new law in 1.4Minnesota Statutes, chapter 326B. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6    Section 1. new text begin [326B.438] MEDICAL GAS SYSTEMS.new text end 1.7    new text begin Subdivision 1.new text end new text begin Definitions.new text end new text begin (a) For the purposes of this section, the terms defined in new text end 1.8new text begin this subdivision have the meanings given them.new text end 1.9new text begin (b) "Level 1 medical piped gas and vacuum system" means a system serving new text end 1.10new text begin occupancies where interruption of the medical piped gas and vacuum system would place new text end 1.11new text begin patients in imminent danger of morbidity or mortality.new text end 1.12new text begin (c) "Level 2 medical piped gas and vacuum system" means a system serving new text end 1.13new text begin occupancies where interruption of the medical piped gas and vacuum system would place new text end 1.14new text begin patients at manageable risk of morbidity or mortality.new text end 1.15new text begin (d) "Level 3 medical piped gas and vacuum system" means a system serving new text end 1.16new text begin occupancies where interruption of the medical piped gas and vacuum system would new text end 1.17new text begin terminate procedures and may place the patient's health at risk, but would not place new text end 1.18new text begin patients at risk of morbidity or mortality.new text end 1.19new text begin (e) "Medical gas system" means a level 1, 2, or 3 piped medical gas and vacuum new text end 1.20new text begin system.new text end 1.21    new text begin Subd. 2.new text end new text begin License required.new text end new text begin No person shall engage in the installation, maintenance, new text end 1.22new text begin or repair of a medical gas system unless the person possesses a current Minnesota new text end 1.23new text begin journeyman plumber's license and is certified by rules adopted by the Minnesota Plumbing new text end 1.24new text begin Board.new text end 2.1    new text begin Subd. 3.new text end new text begin Exceptions.new text end new text begin An employee of the employer with a medical gas system new text end 2.2new text begin may maintain the employer's medical gas system without complying with subdivision 2 new text end 2.3new text begin if the employer employs a person holding current certification from the National Fire new text end 2.4new text begin Protection Association as of August 1, 2009, in medical gas system installation. A person new text end 2.5new text begin so certified by the National Fire Protection Association may maintain and repair an new text end 2.6new text begin employer's medical gas system.new text end 2.7new text begin EFFECTIVE DATE.new text end new text begin This section is effective August 1, 2009, except that the new text end 2.8new text begin requirement that a journeyman plumber must be certified by the Minnesota Plumbing new text end 2.9new text begin Board is not effective until 180 days after the board adopts rules.new text end
