Relating to state government; appropriating money from constitutionally dedicated funds and providing for policy and governance of outdoor heritage, clean water, parks and trails and arts and cultural heritage purposes

ARTICLE 1 - OUTDOOR HERITAGE FUND

Appropriating money from the outdoor heritage fund to commissioner of natural resources (DNR), board of water and soil resources (BWSR), legislative coordinating commission (LCC); specifying funding requirements for prairies including accelerated prairie and grassland management, the green corridor legacy program, prairie heritage fund acquisition and restoration, accelerated prairie grassland wildlife management area acquisition, northern tall grass prairie national wildlife refuge protection, bluffland prairie protection initiative and Rum River Cedar Creek initiative, for forests under certain conditions and requiring a match, for wetlands including accelerated management area acquisition, accelerated shallow lake restorations and enhancements, accelerating the waterfowl production area program, Reinvest in Minnesota wetlands reserve program acquisition and restoration and Shallow Lake critical shoreland, for fish, game and wildlife habitat including the outdoor heritage conservation partners grant program, aquatic management area acquisition, cold water river and stream restoration, protection and enhancement, Dakota county habitat protection, Lake Rebecca water quality improvement project and Fountain Lake fish barriers, for administration and other purposes including contract management and legislative coordinating commission (LCC) expenses; providing an exception for Lessard outdoor heritage council (LOHC) visits; providing for availability of appropriation, cash advances, accomplishment plans, project requirements, payment conditions and capital equipment expenditures, purchase of recycled and recyclable materials, accessibility, land acquisition restrictions and real property interest reporting; allowing the LOHC upon with and approval by the LCC to employ staff and contract with consultants to execute functions and authorizing appropriations from the outdoor heritage fund to pay administrative expenses, compensation and expense reimbursements, establishing additional requirements for the outdoor heritage fund, by expanding upon existing requirements of the LOHC required to make funding recommendations for the use of funds from the outdoor heritage fund, modifying auditing requirements and specifying certain duties of the legislature auditor and modifying legislative oversight requirements; appropriating money from the outdoor heritage fund to commissioner of agriculture for forest protection reserve purposes, specifying certain fund use and reporting requirements; specifying instructions to the revisor of statutes

ARTICLE 2 - CLEAN WATER FUND

Appropriating money from the clean water fund to the department of agriculture for monitoring best management practices in sub-watersheds within the Root River watershed in southeastern Minnesota, for pesticides monitoring, groundwater and drinking water protection activities, for impaired waters restoration projects and assistance with the development of total maximum daily load (TMDL) plans and for the agricultural best management practices loan program, to the public facilities authority for the TMDL grant program, the clean water legacy phosphorus reduction grant program and for small community wastewater treatment grants and loans, to the pollution control agency (PCA) for developing TMDL studies and implementation plans for certain waters, for an enhanced TMDL database, for grants to political subdivisions and ethanol plants demonstrating the beneficial reuse of wastewater, for certain groundwater assessment and drinking protection activities, for the clean water partnership program, for endocrine disruptors water monitoring sites, for coal tar contamination activities, for a restoration project in the lower St. Louis River and Duluth harbor, for the river watch program in the Red River of the North, for comprehensive water monitoring and phosphorus reduction in Lake St. Croix, for statewide assessment and monitoring of surface water quality and trends, for civic engagement in TMDL development, for groundwater protection or prevention of groundwater degradation activities and for grants to the Star Lake board, to the department of natural resources (DNR) for assisting in water quality assessments in supporting the identification of impaired waters, for drinking water planning and protection activities, for TMDL development and implementation plans of certain waters, to acquire and distribute high resolution digital elevation data, to adopt rules for the Mississippi River corridor critical area, for the county geologic atlas program, and for nonpoint source restoration and protection activities, to board of water and soil resources (BWSR) for purchasing and restoring permanent conservation easements on certain riparian buffers, watershed districts and watershed management organizations grants for certain activities, nonpoint source pollution reduction and restoration grants, for the Anoka conservation district metropolitan landscape restoration program, for permanent conservation easements on wellhead protection areas, feedlot water quality improvement grants, for stream bank, stream channel and shoreline protection and restoration projects grants to protect water quality and the conservation drainage program, for a Hennepin county riparian restoration and stream bank stabilization grant, for oversight, support and accountability reporting of local government administration implementation, targeted nonpoint restoration technical assistance and engineering and failing subsurface sewage treatment systems grants and Minnesota conservation corps (MCC) contracted services, to department of health for drinking water source protection, to the university of Minnesota for the comprehensive statewide sustainable water resources detailed framework project and the county geological atlas program, to the legislative coordinating commission (LCC) for Web site costs for containing information on projects receiving appropriations from the outdoor heritage fund, clean water fund and parks and trails fund and to the metropolitan council for implementation of the master water supply plan; modifying certain provisions relating to the reinvest in Minnesota (RIM) program, modifying purpose and policy and drained wetland and riparian land definitions, defining reinvest in Minnesota reserve program, modifying land selection and conservation easement application requirements and considerations, requiring the board of soil and water resources (BWSR) to share information with local soil and water conservation and watershed districts, removing a restriction on bond proceeds; prohibiting state agencies from purchasing undiluted coal tar sealant; establishing the Mississippi River corridor critical area and defining its purpose, specifying administration and duties, authorizing commissioner of natural resources (DNR) to establish districts within the area, establishing minimum guidelines and standards for the districts, specifying certain application of standards, local unit of governments or state agencies notification requirements before taking action on an application, specifying late fees for late notification, rules authority; specifying certain duties of commissioner of pollution control agency (PCA) relating to prevention of water pollution from polycyclic aromatic hydrocarbons and certain duties relating to endocrine disruptor monitoring and analysis; requiring the University of Minnesota to develop a comprehensive statewide sustainable water resources detailed framework to protect the quantity and quality of groundwater and surface water; repealing certain provisions relating to BWSR duties, the conservation reserve program, RIM program technical assistance and repealing certain cost share rates administrative rules

ARTICLE 3 - PARKS AND TRAILS FUND

Appropriating money from the parks and trails fund to department of natural resources (DNR) for the development of a parks and trails long term plan, for certain state parks, recreation areas and trails activities, for Minnesota conservation corps (MCC) contracted services to carry out certain activities, for the parks and trails grant program, the solar energy projects grant program and for undertaking a ten year strategic state parks and trails plan, specifying certain plan consultation requirements, requiring certain reports to the legislature, to the metropolitan council for grants to support parks and trails of regional and statewide significance and for a grant to Hennepin county for the Victory Memorial parkway tree project, to the University of Minnesota for the Center for Changing Landscapes to create a comprehensive statewide parks and trails framework and system inventory and to the legislative coordinating commission (LCC) for Web site costs; providing for the creation of a parks and trails inventory, framework and plan by the University of Minnesota Center for Changing Landscapes, specifying requirements for inventory and framework development and specifying certain duties of commissioners of natural resources and finance relating to parks and trails budget analysis; providing for availability of appropriations; establishing the Minnesota Naturalist Corps under commissioner of natural resources (DNR) supervision and specifying program components; establishing a parks and trails grant program, specifying priorities and match requirements

ARTICLE 4 - ARTS AND CULTURAL HERITAGE FUND

Appropriating money from the arts and cultural heritage fund to the board of the arts, specifying certain grant agreement requirements, authorizing fund use for Minnesota artists and arts organizations, for arts education, for events and activities that represent the diverse ethnic and cultural arts traditions, youth education and grant program administration purposes, requiring a census of Minnesota artists and artistic organization and specifying certain reporting requirements; appropriating money to the department of education for certain Minnesota regional library systems grants; appropriating money to the Minnesota historical society to preserve and enhance access to state history, cultural and historical resources, for statewide historic and cultural grants and requiring the appointment of a historic resources advisory committee, for programs, history partnerships between and with the Minnesota historical society and partnering organizations, for statewide survey of historical and archaeological sites, and a digital library project; appropriating money to the department of administration for the Minnesota public television association, Minnesota public radio, association of Minnesota public educational radio stations and programmatic development of Minnesota's zoos, establishing a cultural grants advisory board, for state capitol restoration, renovation and repair, for the Minnesota children's museum, the Duluth children's museum and the science museum of Minnesota; appropriating money to the Minnesota center for the humanities for certain council of color programs and civics education, to the legislative coordinating commission (LCC) to operate a Web site for dedication funds and to the Perpich center for arts education purposes; appropriating money to Indian affairs council for the working group on Dakota and Ojibwe language revitalization and preservation, for grants for Indian preservation programs and for grants to the Niigaane Ojibwe immersion school and the Wicoie Nandagikendan urban immersion project; specifying certain fund use and accountability requirements for the arts and cultural heritage fund, requiring certain projects to be reviewed and approved by attorney general; establishing public television cultural and heritage production and acquisition grants, specifying uses for grant funds; establishing association of Minnesota public educational radio stations cultural and heritage production and acquisition grants for noncommercial radio stations and specifying uses of grant funds; requiring programs and organizations funded through the arts and cultural heritage fund to conduct a collaborative project to develop a ten year and 25 year framework for the use of money available in the arts and cultural heritage fund and other traditional sources of funding, specifying certain duties and membership requirements; establishing a volunteer working group on Dakota and Ojibwe language revitalization and preservation, specifying certain duties and membership requirements

ARTICLE 5 - GOVERNANCE; GENERAL PROVISIONS

Providing oversight and establishing criteria for expenditures from the parks and trails fund, outdoor heritage fund, clean water fund and environment and natural resources trust fund; requiring the legislative coordinating commission (LCC) to develop and maintain a Web site for constitutionally dedicated funding accountability purposes; defining certain terms relating to native prairie restorations; providing a metropolitan area distribution formula for money appropriated from the parks and trails fund to the metropolitan council, specifying certain data availability requirements; establishing the sustainable drinking water account in the clean water fund, specifying fund use and purpose, expenditures and fund and data availability requirements; recommending the development of a legislative guide stating principles for the use and expected outcomes of all funds from dedicated sales taxes, requiring recommendations to the legislature by a certain date; requiring the legislative committees, divisions, or councils responsible for recommending expenditures to the legislature to develop, with public input and adopt a 25 year strategic plan for fund expenditures, requiring strategic plan applicable outcomes for restoring, protecting and enhancing wetlands, prairies, forests, habitat for fish and game, lake, rivers, streams, groundwater, arts, arts education, arts access, preservation of state history and cultural heritage and supporting parks and trails; requiring the Minnesota board of the arts to sponsor a contest for selecting the design of a logo to use on signage for projects receiving money from the funds
