Relating to state government

ARTICLE 1 - CONTINUING CARE

Modifying certain targeted case management provisions; authorizing the commissioner of human services to award through a competitive process contracts for grants to public and private agencies to support and assist individuals eligible for publicly funded home and community-based services to access housing; providing for nursing facility rate increases beginning October 1, 2009; providing for calculation of quality add-on for the rate year beginning October 1, 2009; requiring demonstration providers providing nursing home and community-based services to provide relocation service coordination to enrolled persons age 65 and over; expanding general assistance (GA) shelter needy eligibility to self-directed supports option participants and home and community-based waiver recipients living independently, extending the state-funded transitional supports allowance to certain persons eligible for shelter needy funding; requiring counties overspending in calendar year 2004 and 2005 under the waivered services program for persons with developmental disabilities to pay back overspending by a certain date; repealing provisions relating to the value-based nursing facility reimbursement system

ARTICLE 2 - AGENCY MANAGEMENT

Eliminating certain commissioner of human services federal fiscal allowances for the foster care program

ARTICLE 3 - STATE-OPERATED SERVICES

Authorizing the commissioner of human services to establish, equip, maintain and operate the Minnesota state industries at any sex offender program facility; establishing a revolving fund and providing for disbursements from the fund; authorizing commissioner to borrow from the fund; providing for federal grant fund transfers; providing for patient wages

ARTICLE 4 - CHILDREN AND FAMILY SERVICES

Defining child support, arrears and maintenance; modifying provisions relating to assignment of support and maintenance rights; modifying provisions relating to distribution of child support; modifying work participation food benefits; modifying provisions relating to support order payments to public agencies; clarifying payor of funds responsibilities relating to paid amounts; modifying the effective date for the expiration of food support benefits; prohibiting the commissioner of human services from claiming an amount in excess of certain TANF/MOE amounts, exceptions; increasing the long term homelessness appropriation; repealing a provision relating to child support distribution

ARTICLE 5 - HEALTH CARE

Modifying provisions relating to operating payment rates; requiring fee-for-service inpatient payments to increase by a certain percentage for a hospital with a medical assistance (MA) inpatient utilizations rate of a certain percent; modifying provisions relating to the partnership for long-term care program; modifying medical assistance eligibility; requiring the health service policy committee to recommend criteria for verifying centers for excellence for specific aspects of medical care under certain conditions; adding an effective date for estimates of actual acquisition costs of drugs; limiting certain co-payments; modifying medical assistance reimbursement collection provisions; requiring federal payments to be at actual costs; eliminating Ramsey county, Regions hospital, the university of Minnesota and Fairview-University medical center from federal matching funds applications; requiring the commissioner to withhold an additional percent of managed care plan payments for the prepaid medical assistance and general assistance medical care programs; modifying provisions for families with children and single adults and households with no children; modifying a prior appropriation for the community-based health care demonstration project; repealing provisions relating to quarterly payment adjustments, Minnesota health care programs outreach incentive program, extended coverage for children and children exception for eligibility for MinnesotaCare

ARTICLE 6 - DEPARTMENT OF HEALTH

Modifying public swimming pool regulations; requiring public pool construction plan professional engineer certification after a certain date; increasing department of health pool, spa pool, slide and project plan review fees; requiring public pools constructed after a certain date to contain a minimum number of suction outlets connected in parallel with suction outlet covers meeting certain ASME/ANSI standards; specifying required equipment for existing public pools; defining certain terms; imposing licensing, fees and license renewal fees on public pools; reducing a prior appropriation to the commissioner of health for fetal alcohol spectrum disorder and the general fund base; specifying instructions to the revisor of statutes to change the definition of public pool in Minnesota Rules, exception for licensed family day care homes; repealing a certain provision relating to implementation of standard transaction sets

ARTICLE 7 - HEALTH AND HUMAN SERVICES APPROPRIATIONS

Providing a summary of health and human services appropriations; reducing appropriations to the commissioner of human services for agency management financial operations, children and economic assistance grants, MinnesotaCare grants, medical assistance (MA) basic health care grants, health care management, continuing care grants and state operated services, to the commissioner of health for community and family health, health protection and administrative support services; appropriating money to health related boards including the board of nursing home administrators, board of chiropractic examiners, board of dentistry, board of veterinary medicine and board of marriage and family therapy; requiring the commissioner of finance to transfer a certain amount from the health care access fund to the general fund on a certain date
