Relating to human services

ARTICLE 1 - HEALTH CARE

Authorizing licensed physicians and licensed psychologists to make a diagnosis and determination of attention deficit disorder (ADD) and attention deficit hyperactivity disorder (ADHD) for the purpose of identifying a child with a disability and eligible for and in need of special education instruction and services; requiring the commissioner of health to modify regulations for home care service providers to include certain home care aide tasks; requiring hospitals, clinics and medical facilities to have in place by a certain date a policy for informing a woman of available options for fetal disposition upon miscarriage; permitting graduates of nonaccredited dental programs completing a clinical licensure examination and meeting certain applicant requirements to be granted a limited general dentist license by the board of dentistry; requiring the volunteer health care provider program administrative services unit to apportion an adjusted fee amount among the boards of medical practice, dentistry and nursing; requiring apportionment distribution amounts to equal amounts expended on medical professional liability insurance coverage purchased by each of the board providers; granting the commissioner the authority to join and participate as a member in a legal entity developing and operating a statewide health information exchange; modifying certain eligibility requirements relating to homestead exclusions for individuals residing in a long term care facility; providing home equity limits for medical assistance (MA) payment of long term care services; modifying asset verification provisions; modifying certain form and statement requirements for the treatment of annuities; expanding MA coverage for certain pregnant women; modifying Minnesota partnership for long term care provisions; modifying application and request requirements for MA eligibility; modifying limitation on liens provisions; authorizing the commissioner to enter into reciprocal agreements; modifying certain provisions relating to the treatment of income and assets of an institutionalized spouse, defining continuous period of institutionalization; modifying the payment of benefits from an annuity and certain prohibited transfers of assets; modifying the period of ineligibility for long term care services for uncompensated transfers by or on behalf of individuals receiving MA payments, modifying certain transfer prohibitions exceptions; providing for a cause of action against transferees under certain conditions; authorizing the county of financial responsibility to bring a cause of action under certain conditions; requiring the health services policy committee to recommend criteria for verifying centers of excellence for specific aspects of medical care; modifying preferred drug lists provisions; modifying medication therapy management services; modifying community health worker provisions to include dentist and certified public health nurse under certain conditions; expanding fee for service provisions; defining institutionalization to mean receiving care in a nursing facility, swing bed or intermediate care facility for persons with developmental disabilities and through home and community based services; revising requirements and procedures for county-based purchasing for state health care programs; requiring demonstration providers to provide relocation service coordination to enrolled persons over age 65; modifying certain language assistance requirements to be provided for enrollees with limited English language proficiency (LEP) by demonstration providers; prohibiting the commissioner from providing the names of potential enrollees to health plans for marketing purposes; modifying dispute mediation panel membership requirements; modifying certain MinnesotaCare enrollment requirements for general assistance medical care purposes; allowing certain claims against an estate; requiring the commissioner of human services to evaluate the extent to which the alternative payment system reimbursement methodology for pension costs leads to funding shortfalls for nursing facilities converting from public to private ownership and report to the legislature by a certain date; requiring the commissioner of human services to study and make recommendations to the legislature by a certain date to reduce rate disparities between nursing facilites in various regions of the state; modifying home and community based waiver services for persons with disabilities allowable expenses provisions to include certain home modifications to accommodate wheelchairs; requiring the commissioner of human services to submit a waiver amendment to the centers for medicare and medicaid services; appropriating money to the administrative unit for medical professional liability insurance coverage; repealing the exchange for long term care partnership policy addition of policy rider provision under the long term care partnership program and a provision repealing the board of dentistry requirement to waive the clinical examination required for the licensure for any dentist applicant graduating from an accredited dental school

ARTICLE 2 - SEX OFFENDER PROGRAM

Providing for the classification of data relating to the preparation of a petition to commit an individual as a sexual psychopathic personality or sexually dangerous person; clarifying the sex offender program to include care and treatment to persons on a court hold order and residing in a secure treatment facility or program; authorizing the commissioner of human services to establish, equip, maintain and operate the Minnesota state industries at any sex offender program facility; establishing a revolving fund and providing for disbursements from the fund; authorizing commissioner to borrow from the fund; providing for federal grant fund transfers; providing for patient wages; permitting certain individuals facing civil commitment as sexually dangerous persons or sexual psychopathic personalities to choose to be confined temporarily in correctional facilities while the petition is being adjudicated; modifying and clarifying the time limit for hearings on civil commitment; allowing county attorneys to obtain access to certain data involving civil commitment cases under certain conditions; modifying the definition of facility to include the department of corrections facility for financial responsibility determination purposes; providing for petitions for a reduction in custody of persons committee as mentally ill and dangerous; allowing county attorneys to obtain access to certain data involving civil commitment cases under certain conditions; modifying the definition of facility to include the department of corrections facility for financial responsibility determination purposes; providing for petitions for a reduction in custody of persons committee as mentally ill and dangerous, providing for appeal; modifying the definition of vulnerable adult; requiring the commissioner of human services to convene a working group of interested parties to develop standards and guidelines for the operations of the sex offender program, requiring a report to the legislature by a certain date

Modifying the definition of work activity and specifying certain county notification requirements to participants in unpaid work experience

ARTICLE 4 - MANAGED CARE CONTRACT

Requiring the commissioner of human services to continue to use single-health plan, county-based purchasing arrangements for medical assistance and general assistance medical care programs and products for counties in single-health plan, county-based purchasing arrangements, clarifying applicability
