1.1A bill for an act 1.2relating to transportation; authorizing creation of Advisory Committee on 1.3Nonmotorized Transportation;proposing coding for new law in Minnesota 1.4Statutes, chapter 174. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6    Section 1. new text begin [174.37] ADVISORY COMMITTEE ON NONMOTORIZED new text end 1.7 new text begin TRANSPORTATION. new text end 1.8     new text begin Subdivision 1. new text end new text begin Purpose. new text end new text begin (a) The commissioner of transportation shall establish new text end 1.9 new text begin an advisory committee on nonmotorized transportation. The committee shall make new text end 1.10 new text begin recommendations to the commissioner on items related to nonmotorized transportation, new text end 1.11 new text begin including safety, education, and development programs. The committee shall review and new text end 1.12 new text begin analyze issues and needs relating to operating nonmotorized transportation on public new text end 1.13 new text begin rights-of-way, and identify solutions and goals for addressing identified issues and needs. new text end 1.14 new text begin (b) For purposes of this section, "nonmotorized transportation" includes bicycling, new text end 1.15 new text begin pedestrian activities, and other forms of nonmotorized transportation. new text end 1.16     new text begin Subd. 2. new text end new text begin Members. new text end new text begin The advisory committee must consist of the following members: new text end 1.17 new text begin (a) The commissioner of transportation shall appoint up to 18 public members, as new text end 1.18 new text begin follows: one member from each of the department's seven greater Minnesota districts; new text end 1.19 new text begin four members from the department's metropolitan district; and no more than seven new text end 1.20 new text begin members at large. Each of the members at large must represent nonmotorized interests or new text end 1.21 new text begin organizations. new text end 1.22 new text begin (b) The commissioners of each of the following state agencies shall appoint new text end 1.23 new text begin an employee of the agency to serve as a member: administration, education, health, new text end 1.24 new text begin natural resources, public safety, transportation, and pollution control. The chair of the new text end 2.1 new text begin Metropolitan Council shall appoint an employee of the council to serve as a member. The new text end 2.2 new text begin director of Explore Minnesota Tourism shall appoint an employee of the agency to serve new text end 2.3 new text begin as a member. The division administrator of the Federal Highway Administration may new text end 2.4 new text begin appoint an employee of the agency to serve as a member. new text end 2.5     new text begin (c) Members of the committee shall serve four-year terms. new text end 2.6     new text begin Subd. 3. new text end new text begin Meetings. new text end new text begin The commissioner of transportation's designee shall convene the new text end 2.7 new text begin first meeting by January 15, 2009. The committee shall elect a chair from its membership, new text end 2.8 new text begin and shall establish a meeting schedule and meet at least annually. new text end 2.9     new text begin Subd. 4. new text end new text begin Reports. new text end new text begin The committee shall issue an annual report to the commissioner new text end 2.10 new text begin of transportation. new text end 2.11     new text begin Subd. 5. new text end new text begin Expenses. new text end new text begin Members of the advisory committee serve without new text end 2.12 new text begin compensation, but members who are not employees of government agencies must new text end 2.13 new text begin be reimbursed for expenses in the same manner and amount as authorized by the new text end 2.14 new text begin commissioner's plan adopted under section 43A.18, subdivision 2.
