1.1A bill for an act 1.2relating to health professions; allowing the return of drugs dispensed by 1.3pharmacies in certain circumstances; assuring certification of prescriptions; 1.4proposing coding for new law in Minnesota Statutes, chapter 151. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6    Section 1. new text begin [151.56] COUNTY RETURN OF UNUSED DRUGS OR MEDICAL new text end 1.7 new text begin DEVICES. new text end 1.8 new text begin Notwithstanding Minnesota Rules, part 6800.2700, pharmacies may accept returns new text end 1.9 new text begin of unused drugs and medical devices from county jails and juvenile correctional facilities. new text end 1.10 new text begin In order to return unused drugs and medical devices, the county jail or juvenile correctional new text end 1.11 new text begin facility must have a trained medication technician on hand twenty-four hours a day, seven new text end 1.12 new text begin days a week and the medication must be stored in a secured locked storage locker. new text end 1.13    Sec. 2. new text begin CERTIFICATION OF PRESCRIPTIONS. new text end 1.14     new text begin The Board of Pharmacy shall require a pharmacist or pharmacist intern at the new text end 1.15 new text begin pharmacy that dispenses, delivers, mails, or ships a completed prescription to the patient new text end 1.16 new text begin to be responsible for assuring that the prescription has been certified prior to completion of new text end 1.17 new text begin the transaction. The pharmacist or pharmacist intern at the pharmacy is not required to new text end 1.18 new text begin directly certify the prescription, if certification has been completed at another pharmacy. new text end
