1.1A bill for an act 1.2relating to airports; creating an advisory task force to study airport funding issues 1.3and the state airports fund; authorizing agreement relating to Willmar airport; 1.4requiring a report; appropriating money. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6    Section 1. new text begin AIRPORT FUNDING ADVISORY TASK FORCE.new text end 1.7    new text begin Subdivision 1.new text end new text begin Task force established.new text end new text begin An advisory task force on airport funding new text end 1.8new text begin issues is established to study and make recommendations regarding the best methods for new text end 1.9new text begin funding airports in the state and the state airports fund. The task force shall study:new text end 1.10    new text begin (1) the adequacy of current sources of revenue for the state airports fund and airports new text end 1.11new text begin in the state;new text end 1.12    new text begin (2) policy considerations regarding the use of the sales tax on aircraft as a potential new text end 1.13new text begin source of revenue for airports;new text end 1.14    new text begin (3) how other states fund airports;new text end 1.15    new text begin (4) projected aviation needs of the future, including required investments in aviation new text end 1.16new text begin infrastructure;new text end 1.17    new text begin (5) aircraft registration taxes; andnew text end 1.18    new text begin (6) other issues relating to the funding of airports as determined by the task force.new text end 1.19    new text begin Subd. 2.new text end new text begin Membership.new text end new text begin (a) The task force is comprised of the following members:new text end 1.20    new text begin (1) two members of the senate tax committee, appointed by the chair of the tax new text end 1.21new text begin committee; andnew text end 1.22    new text begin (2) two members of the house of representatives tax committee, appointed by the new text end 1.23new text begin chair of the tax committee.new text end 2.1new text begin The appointing authorities must select members based on knowledge and experience new text end 2.2new text begin in taxes or aviation funding issues. All appointments required by this paragraph must new text end 2.3new text begin be completed by September 1, 2007. The chair of the task force shall be elected by new text end 2.4new text begin the members appointed by the chairs of the house of representatives and senate tax new text end 2.5new text begin committees at the first meeting of the task force.new text end 2.6    new text begin (b) The chair of the task force may appoint additional nonvoting members to the new text end 2.7new text begin task force, including, but not limited to, representatives of the following organizations new text end 2.8new text begin or entities:new text end 2.9    new text begin (1) a person appointed by the commissioner from the Department of Transportation new text end 2.10new text begin Office of Aeronautics;new text end 2.11    new text begin (2) the Aircraft Owners and Pilots Association;new text end 2.12    new text begin (3) the Experimental Aircraft Association/ACAA;new text end 2.13    new text begin (4) the Metropolitan Airports Commission;new text end 2.14    new text begin (5) the Minnesota Aviation Trades Association;new text end 2.15    new text begin (6) the Minnesota Business Aviation Association;new text end 2.16    new text begin (7) the Minnesota Council of Airports;new text end 2.17    new text begin (8) the Minnesota Seaplane Pilots Association; new text end 2.18    new text begin (9) the National Business Aviation Association; andnew text end 2.19    new text begin (10) municipalities that own or operate airports.new text end 2.20    new text begin (c) The director of the Office of Aeronautics in the Department of Transportation new text end 2.21new text begin shall convene the first meeting of the task force.new text end 2.22    new text begin Subd. 3.new text end new text begin Report.new text end new text begin By February 15, 2008, the task force shall report its new text end 2.23new text begin recommendations to the chairs of the legislative committees with jurisdiction over airports new text end 2.24new text begin and aviation issues and to the legislature as required by Minnesota Statutes, section 3.195. new text end 2.25    new text begin Subd. 4.new text end new text begin Expenses.new text end new text begin Per diem and expenses for legislative members of the task force new text end 2.26new text begin are as provided for under Minnesota Statutes, section 15.059. Other members of the task new text end 2.27new text begin force may not receive per diem or expenses.new text end 2.28    new text begin Subd. 5.new text end new text begin Expiration.new text end new text begin This section expires after the submission of the report as new text end 2.29new text begin required under subdivision 3.new text end 2.30    Sec. 2. new text begin WILLMAR AIRPORT.new text end 2.31    new text begin (a) Notwithstanding any law, rule, or agreement to the contrary, the commissioner new text end 2.32new text begin of transportation may enter into an agreement with the city of Willmar to allow funds new text end 2.33new text begin granted by the state for land acquisition purposes at the city's former airport to instead new text end 3.1new text begin be used by June 30, 2012, as the state's share of funds for eligible aeronautical purposes new text end 3.2new text begin at the city's new airport.new text end 3.3    new text begin (b) Funds not spent pursuant to paragraph (a) by June 30, 2012, must be paid to the new text end 3.4new text begin commissioner of transportation and deposited in the state airports fund.new text end 3.5    Sec. 3. new text begin APPROPRIATION.new text end 3.6    new text begin $200,000 is appropriated from the state airports fund in fiscal year 2008 to the new text end 3.7new text begin Legislative Coordinating Commission for the administrative expenses of the task force new text end 3.8new text begin created in section 1 and for other costs relating to the preparation of the report required new text end 3.9new text begin under section 1, including the costs of hiring a consultant, if needed. Any remaining new text end 3.10new text begin amount of this appropriation shall revert to the state airports fund.new text end 3.11    Sec. 4. new text begin EFFECTIVE DATE.new text end 3.12    new text begin Sections 1 and 3 are effective the day following final enactment.new text end
