4E Modifying certain human services licensing provisions; modifying welfare data use by authorizing certain disclosures to analyze public assistance employment services and program utilization; excluding from human services licensure requirements certain legal adoption homes providing programs for persons placed by a county; permitting residential programs to serve continued stay residents up to a certain age; requiring license holders to develop program policies and procedures necessary to maintain compliance with licensing requirements and requiring license holders upon request to cooperate with state and local government disaster planning agencies working to prepare for or react to pandemic outbreak emergencies; modifying conditional license and fine contested case hearing requirements; including actions of other individuals or conditions in a program as a cause for immediate license holder suspension through an expedited hearing; allowing license suspension, revocation or fine under condition of controlling individuals and individuals subject to background studies having disqualifications; requiring license holders appealing more than one licensing action or sanction to specify actions or sanctions being appealed; restricting maltreatment of minors and vulnerable adults determination, disqualification and reconsiderations; permitting consolidation into a contested case hearing under certain conditions, modifying hearing requirements; clarifying set aside for disqualifications and child care center aids experience requirements; authorizing county agencies to charge a fee to a corporate applicant or license holder to recover the costs of background studies and licensing requirements for adult foster care and child foster care; requiring a license holder requesting a variance to utilize technology as a component of a plan for alternative overnight supervision to request review by the commissioner in the absence of a county recommendation; requiring placement of infants on back by license holders for sudden infant death syndrome (SIDS) prevention and requiring foster care providers and licensed chemical dependency treatment programs, SIDS and shaken baby syndrome instruction documentation; specifying a certain date for child passenger restraint systems training completion for licensed providers; specifying training requirements for child care centers and family child care providers; modifying vulnerable adult license holder requirements for maltreatment corrective actions and prevention plans; requiring license holder determination of vulnerable adult status; specifying child care license holder internal review and corrective action requirements for findings of maltreatment of minors; defining conviction under human services background studies to include guilty pleas and convictions; authorizing the commissioner to request additional information for background studies and compliance failure or refusal constituting disqualification; clarifying background study requirements for license holders with multiple facilities licensed by multiple state agencies; expanding background study individual disqualification from direct contact findings; modifying background study information requirements for county and private agencies, allowing county agencies to accept commissioner background study results for certain educational programs, making technical changes, expanding and modifying permanent and temporary disqualification conditions to include certain crimes; authorizing the commissioner to immediately remove individuals from program positions, expanding disqualification conditions to persons with access to service recipients; modifying conditions of reconsideration for disqualifying maltreatment determinations, conditions for disqualification set aside consideration, fair hearing procedure for disqualifications not set aside, license holder appeal procedure and notice requirements for set aside or variance; authorizing the commissioner of revenue to disclose tax data to the commissioner of human services to verify income for parental contribution calculation for children with disabilities services; modifying the physical abuse definition to include certain accidental injury under maltreatment of minors reporting requirements; clarifying determination of parties responsible for maltreatment of minors and vulnerable adult injuries, specifying conditions for maltreatment of minors and vulnerable adults injuries determinations and disqualification reconsiderations, authorizing counties to certify adult foster care license holders to provide foster care services to individuals with developmental disabilities under certain conditions; requiring the commissioner of human services to seek a federal amendment to the home and community based services waiver for individuals with developmental disabilities to allow medicaid reimbursement for supported living services to a related individual under certain conditions; clarifying the definition of vulnerable adult neglect; requiring the collateral consequences committee to conduct a review of human services background study provisions; repealing department of human services in service training, child care providers cultural dynamics and disabilities training and child care center in service training, first aid and cardiopulmonary resuscitation training and human services background studies individual previously studied provisions
