1E Providing for the financing of prekindergarten through grade 12 education programs and services

ARTICLE 1 - GENERAL EDUCATION

Modifying certain school district levy recognition; modifying general education levy aid; reducing general education aid to cooperative member school districts failing to meet federal special education maintenance of effort; allowing referendum market value to determine district state aid adjustment abatement; specifying instructions to the revisor of statutes; repealing the specific enrollment options in nonresident districts

ARTICLE 2 - EDUCATION EXCELLENCE

Requiring charter and nonpublic schools to transfer student records to student school of residence, requiring inclusion of form disciplinary actions in records transfer; requiring school district to adopt gifted and talented students acceleration policies and procedures; modifying secondary students state graduation test (academic standard) requirements, highly qualified teacher definition for purposes of the federal no child left behind act, district superintendent duties and online learning option enrollment limitations rejection criteria use; authorizing school districts to provide transportation to certain students attending high need english language learner programs; authorizing certain school districts to apply for a waiver from the requirement to maintain racial balance (diversity); eliminating a charter school formation option; clarifying charter school real property leasing restrictions, career and technical levy and American Indian (native American) scholarship award criteria, use, need analysis and allowable postsecondary education levels; requiring the commissioner of education to establish American Indian (native American) scholarship award distribution procedures; specifying instruction to the revisor of statutes; repealing the exemption from license requirements for LEP and ESL teachers

ARTICLE 3 - SPECIAL PROGRAMS

Requiring equalization aid attributable to a student to be included in the nonresident tuition rate determination for nonresident special instruction students; allowing special education care and treatment sites to apply to the commissioner of education for authority to charge resident districts certain additional amounts; authorizing districts to provide extended school year services to certain children with disabilities; requiring state travel aid payment for community based services to children with disabilities; modifying special education special instruction and services base revenue and out of state tuition excess cost aid; including equalization aid in the alternative attendance program general and special education aids determination; repealing special education coordinating interagency services and special education summer school

ARTICLE 4 - FACILITIES AND TECHNOLOGY

Limiting school district capital project levies time duration

ARTICLE 5 - NUTRITION AND ACCOUNTING

Requiring school districts to eliminate certain reserve account established in district general funds prior to a certain date

ARTICLE 6 - LIBRARIES

Requiring the department of education to provide specialized services to the blind and physically handicapped through the Minnesota library for the blind and physically handicapped under a cooperative plan with the national library services for the blind and physically handicapped of the library of Congress

ARICLE 7 - EARLY CHILDHOOD EDUCATION

Specifying a head start allocation full use deadline; requiring the commissioner of education to develop procedures to make program payments based on number of children reported to be enrolled during a certain time and requiring organization applications to include a plan for providing services in conjunction with full day child care programs; requiring the commissioner to require certain phase in of full day services in licensed child care centers and family child care homes, specifying a phase in schedule; defining full day kindergarten; authorizing school boards to charge fees for unreimbursed costs of prekindergarten programs or certain optional full day kindergarten additional costs, exception for certain children with disabilities; allowing school boards and existing private and public prekindergarten programs to enter into written agreements to provide early education under a unified administrative structure and permitting nonprofit corporation or charter school creation; repealing the Minnesota early learning foundation

ARTICLE 8 - SELF-SUFFICIENCY AND LIFELONG LEARNING

Modifying the adult basic education program aid limit; increasing the general education development (GED) test fee; repealing the adult basic education guarantee
