1.1 A bill for an act 1.2relating to health; establishing state policy for stem cell research; providing 1.3criminal penalties;proposing coding for new law in Minnesota Statutes, chapters 1.4137; 145. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6    Section 1. new text begin [137.45] STEM CELL RESEARCH.new text end 1.7    new text begin The University of Minnesota may spend state-appropriated funds on stem cell new text end 1.8new text begin research.new text end 1.9    Sec. 2. new text begin [145.427] STATE POLICY FOR STEM CELL RESEARCH.new text end 1.10    new text begin Subdivision 1.new text end new text begin Research use permitted.new text end new text begin The policy of the state of Minnesota is new text end 1.11new text begin that research involving the derivation and use of human embryonic stem cells, human new text end 1.12new text begin embryonic germ cells, and human adult stem cells from any source, including somatic new text end 1.13new text begin cell nuclear transplantation, shall be permitted and that full consideration of the ethical new text end 1.14new text begin and medical implications of this research be given. Research involving the derivation new text end 1.15new text begin and use of human embryonic stem cells, including somatic cell nuclear transplantation, new text end 1.16new text begin and embryos created for reproduction purposes that are in excess of clinical need and new text end 1.17new text begin voluntarily donated for research shall be reviewed by an embryonic stem cell research new text end 1.18new text begin oversight committee.new text end 1.19    new text begin Subd. 2.new text end new text begin Informed consent.new text end new text begin A physician, surgeon, or other health care provider new text end 1.20new text begin who is treating a patient for infertility shall provide the patient with timely, relevant, and new text end 1.21new text begin appropriate information sufficient to allow the patient to make an informed and voluntary new text end 1.22new text begin choice regarding the disposition of any human embryos remaining following the fertility new text end 1.23new text begin treatment. Any patient to whom information is provided under this subdivision shall new text end 2.1new text begin be presented with the options of storing any unused embryos, donating the embryos new text end 2.2new text begin to another individual, discarding the embryos, or donating the remaining embryos for new text end 2.3new text begin research. Any patient who elects to donate embryos remaining after fertility treatments new text end 2.4new text begin for research shall provide written consent to that donation.new text end 2.5    new text begin Subd. 3.new text end new text begin Prohibiting sale of fetal tissue; cloning of a human being.new text end new text begin (a) A person new text end 2.6new text begin may not knowingly, for valuable consideration, purchase, sell, or otherwise transfer or new text end 2.7new text begin obtain, or promote the sale or transfer of, embryonic or cadaveric fetal tissue for research new text end 2.8new text begin purposes. However, embryonic or cadaveric fetal tissue may be donated for research new text end 2.9new text begin purposes under this section. For purposes of this subdivision, "valuable consideration" new text end 2.10new text begin means financial gain or advantage, but does not include reasonable payment for the new text end 2.11new text begin removal, processing, disposal, preservation, quality control, storage, transplantation, or new text end 2.12new text begin implantation of embryonic or cadaveric fetal tissue. new text end 2.13    new text begin (b) Violation of paragraph (a) is a gross misdemeanor. new text end 2.14    new text begin (c) A person who knowingly engages or assists, directly or indirectly, in the cloning new text end 2.15new text begin of a human being is guilty of a felony. new text end 2.16    new text begin As used in this section, "cloning of a human being" means the replication of a new text end 2.17new text begin human individual by cultivating a cell with genetic material, other than the product of the new text end 2.18new text begin fertilization of the egg of a human female by the sperm of a human male, through the egg, new text end 2.19new text begin embryo, fetal, and newborn stages into a new human individual, and transferring the new text end 2.20new text begin cloned embryo into a woman for gestation and birth.new text end
