1.17We, the undersigned conferees for H. F. No. 2285 report that we have agreed upon
1.18the items in dispute and recommend as follows:
1.19That the Senate recede from its amendment and that H. F. No. 2285 be further
1.20amended as follows:
1.21Delete everything after the enacting clause and insert:
1.22 "Section 1. new text begin CONSTITUTIONAL AMENDMENT.new text end
1.23 new text begin An amendment to the Minnesota Constitution is proposed to the people. If the new text end
1.24new text begin amendment is adopted, a section will be added to article XI, to read: new text end
1.25 new text begin Sec. 15.new text end new text begin Beginning July 1, 2009, until June 30, 2034, the sales and use tax rate shall be new text end
1.26new text begin increased by three-eighths of one percent on sales and uses taxable under the general state new text end
1.27new text begin sales and use tax law. Receipts from the increase, plus penalties and interest and reduced new text end
1.28new text begin by any refunds, are dedicated, for the benefit of Minnesotans, to the following funds: 33 new text end
1.29new text begin percent of the receipts shall be deposited in the outdoor heritage fund and may be spent new text end
1.30new text begin only to restore, protect, and enhance wetlands, prairies, forests, and habitat for fish, game, new text end
2.1new text begin and wildlife; 33 percent of the receipts shall be deposited in the clean water fund and may new text end
2.2new text begin be spent only to protect, enhance, and restore water quality in lakes, rivers, and streams new text end
2.3new text begin and to protect groundwater from degradation, and at least five percent of the clean water new text end
2.4new text begin fund must be spent only to protect drinking water sources; 14.25 percent of the receipts new text end
2.5new text begin shall be deposited in the parks and trails fund and may be spent only to support parks and new text end
2.6new text begin trails of regional or statewide significance; and 19.75 percent shall be deposited in the arts new text end
2.7new text begin and cultural heritage fund and may be spent only for arts, arts education, and arts access new text end
2.8new text begin and to preserve Minnesota's history and cultural heritage. An outdoor heritage fund; a new text end
2.9new text begin parks and trails fund; a clean water fund and a sustainable drinking water account; and new text end
2.10new text begin an arts and cultural heritage fund are created in the state treasury. The money dedicated new text end
2.11new text begin under this section shall be appropriated by law. The dedicated money under this section new text end
2.12new text begin must supplement traditional sources of funding for these purposes and may not be used new text end
2.13new text begin as a substitute. Land acquired by fee with money deposited in the outdoor heritage fund new text end
2.14new text begin under this section must be open to the public taking of fish and game during the open new text end
2.15new text begin season unless otherwise provided by law. If the base of the sales and use tax is changed, new text end
2.16new text begin the sales and use tax rate in this section may be proportionally adjusted by law to within new text end
2.17new text begin one-thousandth of one percent in order to provide as close to the same amount of revenue new text end
2.18new text begin as practicable for each fund as existed before the change to the sales and use tax.new text end

2.20 new text begin (a) The proposed amendment shall be submitted to the people at the 2008 general new text end

2.23new text begin drinking water sources; to protect, enhance, and restore our wetlands, prairies, forests, new text end

2.25new text begin our parks and trails; and to protect, enhance, and restore our lakes, rivers, streams, new text end
2.26new text begin and groundwater by increasing the sales and use tax rate beginning July 1, 2009, by new text end
