1.1A bill for an act 1.2relating to disaster relief; appropriating money for lake cleanup in LeSueur 1.3County; proposing coding for new law in Minnesota Statutes, chapter 103G. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5    Section 1. new text begin [103G.122] COMMISSIONER'S AUTHORITY TO REMOVE new text end 1.6 new text begin DEBRIS. new text end 1.7     new text begin (a) The commissioner shall remove debris from public waters that was: new text end 1.8     new text begin (1) caused by a disaster or a public emergency as defined in chapter 12; and new text end 1.9     new text begin (2) constitutes a threat to public safety in any way, including swimming, boating, or new text end 1.10 new text begin other recreational use of the public waters. new text end 1.11     new text begin (b) A statutory or home rule charter city or county may allow residents and adjacent new text end 1.12 new text begin property owners to place debris retrieved from public waters onto the public access for new text end 1.13 new text begin pickup. new text end 1.14    Sec. 2. new text begin PUBLIC WATERS DEBRIS CLEARANCE FUND. new text end 1.15     new text begin Subdivision 1. new text end new text begin Fund created. new text end new text begin A public waters debris clearance fund is created to new text end 1.16 new text begin assure that public waters are cleaned and maintained from debris that is deposited into the new text end 1.17 new text begin public waters by disasters, as defined in Minnesota Statutes, chapter 12. new text end 1.18     new text begin If the governor has declared a state of emergency, money in this fund shall be new text end 1.19 new text begin appropriated to the commissioner of natural resources for the removal of debris, which new text end 1.20 new text begin were deposited by a disaster, from public waters. The commissioner of natural resources new text end 1.21 new text begin may contract or provide grants to local governments to accomplish these purposes. new text end 1.22     new text begin If a federal disaster is declared, the reimbursement for debris removal from public new text end 1.23 new text begin waters must be deposited into the public waters debris clearance fund. new text end 2.1     new text begin Subd. 2. new text end new text begin Appropriation. new text end new text begin $2,000,000 is appropriated from the general fund for fiscal new text end 2.2 new text begin year 2008 to the commissioner of natural resources, for deposit into the public waters new text end 2.3 new text begin debris clearance fund. This is a onetime appropriation that is available until expended. new text end 2.4    Sec. 3. new text begin APPROPRIATION; TORNADO RELIEF. new text end 2.5     new text begin $79,000 is appropriated from the general fund for fiscal year 2007 to the new text end 2.6 new text begin commissioner of employment and economic development for a grant to Le Sueur County new text end 2.7 new text begin for the cost of cleaning debris from lakes in Le Sueur County, caused by the August new text end 2.8 new text begin 24, 2006, tornado in southern Le Sueur County. This appropriation is available until new text end 2.9 new text begin June 30, 2008. new text end 2.10 new text begin EFFECTIVE DATE. new text end new text begin This section is effective the day following final enactment. new text end
