A bill for an act
relating to health; requiring a warning label on certain items containing lead;
prohibiting the sale of lead-containing items to minors; proposing coding for new
law in Minnesota Statutes, chapter 144.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) No person shall intentionally offer for
sale or sell jewelry or an item of personal decoration containing more than .5 percent lead
content unless it bears a warning label clearly visible to the buyer.

(b) The commissioner shall adopt rules to implement paragraph (a). In order to
minimize the burden on retail sellers, rules must, to the extent practicable, place the
obligation to affix labels on the producer or packager, rather than on the retail seller.

No person shall intentionally offer for sale or sell any
jewelry, item of personal decoration, toy, or clothing containing lead that is intended for
use by a child under the age of 12.
